ORDER NO. 17710 REQUEST OF JOAN DELL WEAVER DOLCE, REGARDING DIVISION OF PROPERTY LOCATED IN KERR COUNTY COMMISSIONER'S PRECINCT TWO On this the 2nd day of February 1988, came on to be considered by the Court the request of Joan Dell Weaver Dolce, as to whether or not the division of a tract of land to be gift deeded in five tracts to the five daughters of Mr. and Mrs. Raymond Mosty (said property located in Kerr County Commissioner's Precinct Two) would be considered a subdivision, under the Kerr County Subdivision "RULES AND REGULATIONS". Said tracts range in size from 26.73 acres to 43.78 acres and there is no development contemplated on any of the tracts. Motion was made by Commissioner Ray, seconded by Commissioner Baldwin and unanimously approved and determined by the Court that said division of property is not subject to the require- ments of the Kerr County Subdivision "RULES AND REGULATIONS", as concerns platting, and that said request be granted, with the stipulation that the County be given a 60' right of way on Elm Pass Road and no variance to be granted on Septic Tank Regulations, or compliance in the future with all sub- division regulations. The reason for this division of property was to accomplish gifts to each of their five daughters pursuant to a comprehensive estate plan. The tracts range in size from 26.73 acres to 43.78 acres. There is no development contemplated on any of the tracts. As previously stated, these conveyances are prompted by an effort to minimize estate taxes.
