ORDER NO. 17924 REQUEST OF RUSK PROPERTIES COMPANY FOR VARIANCE FROM KERR COUNTY SUBDIVISION "RULES AND REGULATIONS", CONCERNING A 4,460 ACRE TRACT On this the 31st day of May 1988, came on to be considered by the Court the request of RUSK PROPERTIES COMPANY , as to whether or not a 4,460 acre ranch near Kerrville, known as Cypress Creek Ranch (formerly Whiskey Canyon Ranch), located in Kerr County Commissioner's Precinct 3, would be considered a subdivision, under the Kerr County Subdivision "Rules and Regulations". Said tracts range in size from 240f acres to 7601 acres. Motion was made by Commissioner Lich, seconded by Commis- sioner Baldwin and unanimously approved and determined by the Court that said tract of 4,460 acres is not subject to the requirements of the Kerr County Subdivision "Rules and Regulations", as concerns platting, and that said request be granted, subject to approval by the City of Kerrville and that that no tracts smaller than 200 acres will be sold. f May 19, 1988 Mr. Jerry Menefee County IIlgineer Kerr County Courthouse Kerrville, Texas 78028 Dear Mr. Menefee, ~~ 1~F1-r 3IsT ~ ,L~ -~S Rusk Properties Company owns a 4,460 acre ranch near Kerrville known as the Cypress Creek Ranch (formerly Whiskey Canyon Ranchj which we are currently marketing. We have recommended to Rusk Properties Company that to successfully market the property, the ranch would need to be divided into parcels, versus trying to market the property as one tract. We are proposing the ranch to be divided into approximately nine tracts that would vary in size from 240E acres to 760E acres. Seven of these tracts under the proposal would exceed 400 acres per parcel. The property has been and currently is being utilized for agricultural purposes aryl it is anticipated that the use will be continued. Access to the tracts is proposed to be from existing entrances frcan state and county roads and private roads within the ranch. A topography map of the ranch indicating proposed tracts is attached along with a sheet indicating the approximate sizes. I understand tyre next-Kerr County Cbnttrissioners Court meeting will be on May 31, 1988 and I would like to request to be placed on the agenda to present this matter to the court and seek a variance from the existing Kerr County Subdivision Regulations.
