BIDDER'S PROPOSAL FOR MOWING C'QNTRAt'I'

Gentlemen:
Reference is made to the Following described work of construction, alteration, repair or
maintenance:
Mowing various roads in Kerr County.
The undersigned Bidder has carefully examined and considered the site of the Work, relevant
conditions and circumstances and the proposed Contract Documents, including the Form or
AgreementSchedule of Special Conditions, General Provisions, Drawings and Spec cations
prepared be Kerr County.
Special instructions to Bidders, and the following numbered and dated addendas:
The work will be completed as noted in the attached sheets fallowing ezecution of the
Agreement by Kerr County.
It is understood that Performance and Payment Bonds, each in the amount of 100X of the
Contract Price, will be required if the Contract Price ezceeds 525,000: That Kerr County may
accept this bid as late as thirty (30) days following the date of opening of bids and that Kerr
County map waive abjection to any informality in submission of bids.
This proposal is accompanied by a bank cashier's check or a Bid Boad (oa the form prescribed
by Kerr County) made payable to Kerr County in amount equal to five percent of the mazimum
Contract Price above bid, which sum will be received and retained by gerr County as liquidated
damages in the event that the undersigned Bidder should fail, if awarded the Contract within
ten (10) days thereafter to execute and return the Agreement, together with Performance and
Payment Bands as indicated.
The undersigned reserves the right to withdraw or amend this Proposal at any time before the
time for closing receipt of bids.
It is understood that the quantities of work to be done are approximate only, and are intended
principally to serve as a guide in computing bids.
Il is further understood that the quantities of work to be done may be increased or diminished
as may be considered necessary, in the opinion of the Engineer, and that all quantities of
work, whether increased or decreased, are to be performed at the unit prices set forth in the
Bid Item Sheet ezcept as provided in the General Requirements.
Based on the foregoing, the undersigned Bidder hereby offers and proposes to perform the
work, the full accord with the Contract Documents, for a Contract Price computed and time
duration (cycle) as shaven in the following Pricing Schedule, but subject to adjustments as
provided in the Contract Documents.

days to complete one (i) cycle.
(3) The Contract price may be increased or decreased or the contract time reduced or eztended
to compensate for changes in the Work as ordered bq the County Engineer and provided
for by the conditions of the contract.
(4) I shall accept all liability resulting from the actions of my employees or myself and shall
hold the Kerr County free of any liability should I be awarded the project.

SPECIFICATION DATA
FOR
MOWING COUNTY ROADS
I. GENERAL
This contract becomes effective as of the date that Kerr County signs the Contract
Documents. The Contractor will be allowed one week from that date to begin work.
II. SCOPE OF WORK
Mow an area approzimately 10 feet wide on each side of the roadway or shoulder for each
of the raadpays on the attached list with the maaimum height of cut grass to be siz (6) inches.
III. WORK PROSECUTION
A working day is defined as a calendar day, not including Saturdays, Sundays or legal
holidays authorized by Kerr County, in which weather or other conditions not under the
control of the contractor will permit the performance of mowing operations for a continuous
period of nat less than seven (7) hours between 7:00 A.M. and 6:00 P.M. Work on Sundays will
not be permitted. For every Saturday on which the contractor chooses to work, one day will be
charged against the contract time when weather conditions will permit seven (7) hours of
work as delineated above. The contractor shall complete each cycle of the work within the
number of working days stated in the contract. For the purpose of computation, working days
will be considered to begin on the 8th day after the date of written notice by Kerr County, to
begin work. After the satisfactory completion of each cycle of mowing, upon request by the
contractor, a statement showing total number of working days used will be furnished by Kerr
County.
IV. SIGNING AND TRAFFIC CONTROL
It is the responsibility of the Contractor to provide adequate signing and traffic control
for the protection of equipment and employees, and the warning of motorists in the vicinity of
work in progress.
V. OBSTRUCTIONS INRIGHT-OF-WAY
The Contractor shall make every effort to minimize destruction to ornamental shrubbery,
utilities, fences, and other obstructions in the right-of--way. Should any items be damaged by
the Contractor; it sha[i be the sole responsibility of the Contractor to effect any repairs.
VI. E%ECUTION OF CONTRACT AND BONDS
Within 10 days after Kerr County awards a contract over 525,000.00, the bidder shall
ezecute and furnish the County the contract, a Performance Bond in the full amount of the
contract and a Payment Bond in the full amount of the Contract. Letters of Credit may be
submitted in lieu of the required bonds subject to approval of the Kerr County Commissioners
Caurt.
If the IOt6 day falls on aCounty-observed hatiday, the ezecuted contract and bonds will be
due not later than 5:00 P.M. the neat regularly scheduled working day. It is the contractor's
responsibility to see that the ezecuted contract and bonds are delivered to the Kerr County
Road and Bridge Department.
When required, the Performance Bond shall be furnished as a guaranty of the faithful
performance of the work and the Payment Bond shall be furnished for the protection of the
claimants for labor and materials. The bonds shall be executed be a surety company or surety
companies authorized to execute surety bonds under and in accordance with the laws of the
State of Tezas.
When the amount of the contract is 525,000.00 or less, a Performance Bond and a Payment
Bond will nut be required.
Should the bidder to whom the contract is awarded fail to have the executed contract and
bonds when required at the Kerr County Road and Bridge Department the 10th day after award,
excepting legal holiday(s) as provided,the contract shall be automatically declared in default
and the Proposal Guaranty filed with the bid shall become the property of the County, not as a
penalty but as a liquidated damages.
YII. PAYMENT
The Contractor shall submit on the first working day of the month all invoices for work
completed in the previous month. Payment may only be claimed by the Contractor for those
roadway segments where all mowing has been completed at the date of the invoice submission.
Partially completed roadway segments will not be considered for payment.
Prior to approve! far payment by the Commissioners Court, the County Engineer or other
designated representative will review work performed for which payment is sought. The
County Engineer may elect to reduce the amount of the invoice claimed should the wort in his
opinion be of a substandard nature.p
All invoices will be considered by the Kerr County Commissioners Court no later than the
second Monday of each month in which the invoice is submitted. Paymentwill be made in
most cases the day after the court session in which payment was approved.
The undersigned Bidder, by signing and ezccuting this bid, certifies and represents to Kerr
County that Bidder has not offered, conferred or agreed to confer any pecuniary benefit, as
defined by Tezas Penal Code Ann S218, or any other thing of value, as consideration for the
receipt of information or any special treatment or advantage relating to this bid; the Bidder
also certifies and represents that Bidder has not offered, conferred or agreed to confer any
pecuniary benefit or other thing of value as consideration for the recipients decision,
opinion, recommendation, vote or other ezercise of discretion concerning this bid; the Bidder
certifies and represents that Bidder has neither coerced nor attempted to influence the
ezercise of discretion by any officer, Commissioner, agent or employee of Kerr County
concerning this bid on the basis of any consideration not authorized by law; the Bidder also
certifies and represents that Bidder has not received any information not available to other
bidders so as to five the undersigned a preferential advantage with respect to this bid; the
Bidder further certifies and represents that Bidder has not violated any state, federal or local
law, regulation or ordina,ace relating to bribe, improper influence, collusion or the like and
that bidder will not in the future offer, confer, or agree to confer a pecuniary benefit or other
thing of value to any officer, commissioner, agent or employee of Kerr County in connection
with information regarding this bid, the submission of this bid, the award of this bid or the
performance, delivery or sale pursuant to this bid.
