On this the 23rd day of February 1989, upon motion made by
Commissioner Ray, seconded by Commissioner Baldwin, the Court
unanimously approved the City of Kerrville to accept bids for
the demolition/removal of the house on airport property,
located at 300 Johnson Drive, with the concurrence of the
City.

Dear Commissioner Ray:
Enclosed is a copy of the agenda bill presented to the
Kerrville City Council in their meeting of January 24, 1989,
for the demolition/removal of the house on airport property,
along with three other city structures. This item passed
Council by unanimous vote. The demolition/removal of the
City/County owned house at the airport was later passed by the
Airport Board at their February 15 meeting.
You had mentioned at the Airport Board meeting that you would
be putting this item on the agenda for the County Commission-
ers Court meeting of February 23, 1989. I am providing the
enclosed information should you desire to supply it as backup
data for this agenda item.
Unfortunately, I will be in Austin February 19 through 22, _but
if you have any questions, please contact my secretary at
257-8000, extension 203, and she will transfer the information
to me. I will be back in touch as soon as possible. I will

Staff has spent considerable time reviewing vacant housing unit
properties owned by the city. These houses have been evaluated to
determine livability, value to the city, and the cost of repair
versus the value of each unit. The potential liabilities associated
with each vacant structure were also considered. After~oOreviewing
the city's houses, staff recommends the dwellings at 6-24-Hays, 628
Hays, 300 Johnson (city property located east of airport), and fr2;s,~2S
Clay be either removed from these properties or demolished. All of
the above structures are in such a state of disrepair that restora-
tion by the city would be prohibitive. Also, in their present state
these houses pose a liability to the city.
Staff requests Council approval to issue requests for proposal for
the removal of these buildings, or as an alternative proposal, the
demolition of these structures by an outside contractor.
The structure at 628 Hays Street has been used in the past by the
Salvation Army as a site for their low income dental facility and as
a storage location. The Salvation Army has been contacted regarding
the proposed demolition or removal and they concur. This structure
and land are city property.
For photographs of these structures see Attachment 2.
RECOMMENDED ACTION
Staff recommends authorization to solicit requests for proposal for
the removal or demolition of these buildings.

NOTICE TO BIDDERS
Sealed bids addressed to the City of Kerrville will be received
by the Office of the City Clerk, City Hall, 800 Junction High-
way, Kerrville, Texas 78028, and then publicly opened at 3:00
p.m. on 1989, in Meeting Room No. One, for

at the following locations:

in accordance with specifications of the City of Kerrville.
Said specifications may be secured from the Office of the Insur-
ance Manger/Performance Specialist, 800 Junction Highway,

The date and time of opening bids shall be clearly marked on
the outside of the sealed envelope. No bids will be accepted
after 3:00 p.m. on the date of bid opening.
The right is reserved, as the interest of the City of Kerrville
may require, to reject any and all bids and to waive any infor-
mality in the bids received.
No payments will be made to the successful bidder until project
completion.

DEMOLITION/REMOVAL AGREEMENT
CITY OF KERRVILLE, TEXAS
The City of Kerrville, Texas has declared that certain dwell-
ings or buildings located within the city should be demol-
ished/removed. These buildings are city property; ands:
Whereas, hereinafter
referred to as Contractor, agrees to accomplish demolition of,
or removal of, such structures, the following procedures and
provisions are hereby agreed to and established between the
City and the Contractor for demolition/removal:
1. The contractor agrees to indemnify, save harmless and ex-
empt the City of Kerrville, its officers, agents, servants,
and employees from and against any and all suits, actions,
legal proceedings, claims, demands, costs, expenses, and
attorney's fees incident to any of the contractor's acts or
omissions in the demolition of the structure(s) and acts
associated with the demolition and removal, even though it
be contended or proved that the city's negligence contribut-
ed to such suit, liability or expense.
The Contractor will be responsible for adherence to all
proper legal procedures required prior to demolition/
removal.
3. Contractor will demolish and remove all lumber, concrete,
and other such materials and debris from the property,
including the foundation, at his expense.
4. All lumber and materials removed from the premises will be
the property of the Contractor unless otherwise specified.
5. Unless otherwise permitted by the City of Kerrville, all
buildings must be demolished on the property of the struc-
ture's location. Said buildings may be rehabilitated at
another location.
6. The Contractor must reveal to the City his plans for stor-
age and/or use of all materials. Such plans will be sub-_
ject to review and approval of the City, and must be ad-
hered to by the Contractor. The city landfill shall be
used for disposal of all waste, except for any dirt, con-
crete, brick, and pavement waste which may be placed at
other locations, with city approval. (Landfill manifests
may be required as evidence of proper disposal of waste.)
7. Location(s) of structures covered under this contract are
as follows:

8. Contractor will complete demolition/removal and clear the
above mentioned property of all lumber, material, trash and
debris not later than

TEAR DOWN PROCEDURES
(Effective 3/18/87)

1. Fill out application.
2. Contractor will notify electric, gas, and water companies
to discontinue service and pull meters.
3. Permit will then be issued upon receipt of agreement signed
by owner of property (attached) and payment of a $25.00
permit fee by the Contractor.
4. Contractor will locate and uncover the sewer line at the
service location.
5. Inspection Department should be notified for an inspection;
inspector will then give instruction on capping sewer line.
6. After sewer line is capped, Inspection Department must be
notified.
7. The inspector must verify the location and see that the
curb is properly marked.
