This item passed Council by unanimous vote. The demolition/removal of the City/County owned house at the airport was later passed by the Airport Board at their February 15 meeting. You had mentioned at the Airport Board meeting that you would be putting this item on the agenda for the County Commission- ers Court meeting of February 23, 1989. I am providing the enclosed information should you desire to supply it as backup data for this agenda item. These houses have been evaluated to determine livability, value to the city, and the cost of repair versus the value of each unit. The potential liabilities associated with each vacant structure were also considered. After~oOreviewing the city's houses, staff recommends the dwellings at 6-24-Hays, 628 Hays, 300 Johnson (city property located east of airport), and fr2;s,~2S Clay be either removed from these properties or demolished. All of the above structures are in such a state of disrepair that restora- tion by the city would be prohibitive. Also, in their present state these houses pose a liability to the city. Staff requests Council approval to issue requests for proposal for the removal of these buildings, or as an alternative proposal, the demolition of these structures by an outside contractor. The structure at 628 Hays Street has been used in the past by the Salvation Army as a site for their low income dental facility and as a storage location. The Salvation Army has been contacted regarding the proposed demolition or removal and they concur. This structure and land are city property. For photographs of these structures see Attachment 2. These buildings are city property; ands: Whereas, hereinafter referred to as Contractor, agrees to accomplish demolition of, or removal of, such structures, the following procedures and provisions are hereby agreed to and established between the City and the Contractor for demolition/removal: 1. The contractor agrees to indemnify, save harmless and ex- empt the City of Kerrville, its officers, agents, servants, and employees from and against any and all suits, actions, legal proceedings, claims, demands, costs, expenses, and attorney's fees incident to any of the contractor's acts or omissions in the demolition of the structure(s) and acts associated with the demolition and removal, even though it be contended or proved that the city's negligence contribut- ed to such suit, liability or expense. The Contractor will be responsible for adherence to all proper legal procedures required prior to demolition/ removal. 3. Contractor will demolish and remove all lumber, concrete, and other such materials and debris from the property, including the foundation, at his expense. 4. All lumber and materials removed from the premises will be the property of the Contractor unless otherwise specified. 5. Unless otherwise permitted by the City of Kerrville, all buildings must be demolished on the property of the struc- ture's location. Said buildings may be rehabilitated at another location. 6. The Contractor must reveal to the City his plans for stor- age and/or use of all materials. Such plans will be sub-_ ject to review and approval of the City, and must be ad- hered to by the Contractor. The city landfill shall be used for disposal of all waste, except for any dirt, con- crete, brick, and pavement waste which may be placed at other locations, with city approval.
