ORDER NO. 18503 MOTION TO RATIFY TASK FORCE AGREEMHNT On this the 9th day of March 1909, upon motion made by Commissioner Baldwin, seconded by Commissioner Morgan, the Court unanimously approved to ratify the Task Force Agreement approved in the Budget in October, and to authorize the County Judge to sign on behalf of the County. F INTERAGENCY AGREEMENT REVIEW AND APPROVAL STATE OF TEXAS This Agreement is entered into by and between Kerr County, Bandera County, Kendall County, Gillespie County, political subdivisions of the State of Texas, hereinafter referred to as Counties" and the City of Kerrville, a municipal corporation situated in Kerr County, Texas; City of Bandera, a municipal corporation situated in Bandera County, Texas; City of Boerne, a municipal corporation situated in Kendall County, Texas, City of Fredericksburg, a municipal corporation situated in Gillespie County, Texas, hereinafter called "Cities", pursuant to the Interlocal Cooperation Act, Art., 4413 (32C),. Tex. Rev. Civ. Stat. (Ve_rnon's 1976). WHEREAS, the "Counties" and "Cities" have agreed to contribute the total of $5,000.00 in matching funds if said joint application is approved; and WHEREAS, the source of funds would not normally be used for this purpose; and WHEREAS, the "Counties" and "Cities" believe it to be in their best interests to join in the applications to develope an area Narcotics Task Force. (1) s 1 NOW THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: ARTICLE I PURPOSE 1.01 The purpose of this Agreement is to allow "Counties" and "Cities" to file joint application for a Narcotics Task Force Grant, with the Criminal Justice Division, which creates, the 216th JUDICIAL DISTRICT NARCOTIC TASK FORCE which applilcation is attached hereto as exhibit "A" and made a part hereof for all purposes. ARTICLE II TERM 2.01 The term of is Agreement is to commence on the execution of this Agreement and to end August 31, 1989. ARTICLE III CONSIDERATION 3.01 As consideration of this Agreement, "Counties" and "Cities" agree to contribute a total of $5,000.00 in matching funds (in-kind) for the enhancement of the 216th Judicial District Narcotic Task Force. ARTICLE IV v, OWNERSHIP OF EQUIPMENT 4.01 Upon termination of this Agreement, ownership of equipment, hardware, and other non-expendable items will revert to s the applicant for which it was acquired, subject to the approval of the Criminal Justice Division of the State of Texas. (2) 1 ARTICLE V AMENDMENTS S.O1 This Agreement; may be amended by the mutal agreement of the parties hereto in writing to be attached to and incorporated into this agreement. ARTICLE VI LEGAL CONSTRUCTIONS 6.01 In case any one or more of the provisions contained in this Agreement shall be held to be invalid, illegal, or unenforceable in any respect such invalidity, illegality, or unenforceability shall not affect any other provision therof and this Agreement shall be construed as if invalid, illegal, or unenforceable provision had never been contained herein.
