Recently, Commissioners Court Order No. 18003 was sent to me
indicating that my approval of a Letter of Credit from Mr. John
W. Herring, Jr. was necessary. °
Please find enclosed a copy of the master Trust Agreement in
Lieu of Maintenance Bond, and Letter of Credit issued to Mr.
Gerald Menefee on April 14, 1988. My instructions were that this
could be used as a standard master form for future Trust
Agreements and Letters of Credit concerning maintenance bonds.
In reviewing the Letter of Credit, it appears that it
exactly duplicates the master Letter of Credit. The only
question would be verification of the information placed in the
blanks, in particular, the expiration date of the Letter of
Credit. This Letter of Credit is satisfactory in the sense that
it is an exact duplicate of the master I issued for lase. Please
address the issue of its expiration date as a matter which the
Commissioners Court itself must find satisfactory.
In the future, if you receive Trust Agreements in Lieu of
Maintenance Bond and Letters of Credit which match the master
documents included herewith, you may consider them to be approved
and satisfactory to the County Attorney. Thg only question which
the Commissioners Court and the County Engineer will need to
address is that of whether or not the specific information placed
in the blanks is satisfactory, including the issue of the
expiration date of the Letter of Credit, I leave those
particular items to your discretion.

We hereby establish our irrevocable letter of credit in favor of KERR
COUNTY, a political subdivision of the State of Texas, available by
your one or more drafts on sight for any sum of money not to exceed a
total cumulative amount of $3,780.00 (Three Thousand Seven Hundred and
Eighty Dollars Only).
This letter of credit is given on behalf of John W. Herring, Jr „ and
concerns the subdivision known as HIGH POINTS ,
consisting of 9z.1a acres.
Each draft must bear on its face "Drawn under Letter of Credit No,
1369, dated July 19. 1988 of John W, Herring, Jr, in favor of Kerr
County, Texas."
Each draft shall be accompanied by the following;
1, Copy of this letter of credit.
2, Copy of Kerr County Commissioners Court resolution Containing
the following:
a. Statement that John W, Herring, Jr. has failed to provide
road and site maintenance in accordance with Kerr County
Subdivision Regulation standards,
b. Statement of the estimated cost of, or funds expended for,
such road or site maintenance,
c. Statement that this letter of credit be drawn against in
such amount.
d, Naming of person authorized to sign all documents
necessary for drawing on this letter of credit on behalf of
Kerr County.
We hereby agree that drafts drawn under and in compliance with this
Letter of Credit will be duly honored if presented on or before July
19, 1989.

TRUST AGREEMENT
IN LIEU OF MAINTENENCE BOND
This agreement is between CEDAR RIDGE LAND COMPANY, ("Subdivider"),
and KERR COUNTY, TEXAS.
Subdivider has deposited with and in favor of KERR COUNTY, TEXAS,
an original Letter of Credit from CHAS. SCHREINER BANK, (attached here-
to) in the total sum of $3,780. for the purpose of guaranteeing mainte-
nance of all road and site improvements in the subdivision known as
HIGH POINTE, in Kerr County, Texas, consisting of 92.18 acres, in ac-
cordance with Kerr County Subdivision Regulation standards, for the
benefit of the public as represented by KERR COUNTY.
Subdivider agrees to maintain all road and site improvements for
one (1) year from the date of final approval of the plat of said sub-
division. Upon the failure of the subdivider to maintain such road and
site improvements as herein provided, at any time during said one year
period, KERR COUNTY shall have the right to draw against the letter of
credit for the purpose of repairing, maintaining or otherwise working
on the road and site improvements in such subdivision. A resolution of
the Commissioners Court of Kerr County containing the following shall be
final and conclusive.
1. Statement that Subdivider has failed to provide road and site
maintenance in accordance with Kerr County Subdivision Regula-
tion standards.
2. Statement of the estimated cost of or funds expended for, such
road or site maintenance.
3. Statement that the Letter of Credit attached be drawn upon in
such amount.
4. Naming of person authorized to sign all documents necessary for
drawing on this Letter of Credit on behalf of KERR COUNTY.
