Edwards county Judge Kerr County Courthouse Kerrville, Texas 78028 Re: High Pointe Sub-division to Kerr County., Texas Highpointe at Riverhill Sub-division to Kerrville, Kerr County, Texas Dear Mr. Vetter and Judge Edwards: Mr. John Herring, owner of the High Pointe Subdivision to the County of Kerr, State of Texas, tells me that you are both familiar with the problem about there being two High Pointe Subdivisions in Kerr County. A Mr. David Cummings and a partner represented by Mr. Rit Jons, have also obtained approval of a subdivision with a deceptively similar name. This will cause problems with the 911 Emergency, Fire Department, Police Department, and various other agencies in the county as well as the Post Office. This is especially so since both subdivisions have streets named High Pointe Drive and Highpointe Drive. If an emergency vehicle is dispatched to a street or subdivision known as High Pointe or Highpointe and it goes to the wrong one and it results in a death or substantial damage to someone, :rho is going to accept the responsibility for those damages? I can assure you that my client is not, since he has protested the approval of the second subdivision with a deceptively similar name and the exact same name of the streets. I would like to suggest two actions to the City and Commissioner's Court, to wit: 1. That both the County and the City formally adopt a policy that no subdivision will be approved that have deceptively similar names and this would extend as well to the names of streets in those subdivisions; and 2. That both the City and County proceed to disapprove the plat of the said second High Pointe Subdivision, since the first had been approved about two (2) years before. It seems that a subdivision plat under the name of High Pointe was filed in the County in July of 1988. Within the subdivision, there is a street named High Pointe Drive. Recently, a plat was filed with the City under the subdivision name of Highpointe at Riverhill. Within the subdivision, there are streets named Highpointe Drive and Highpointe Court. Prior to the filing of the plat with the City, your staff had received a copy of the plat which had been filed with the County in 1988. It is obvious that we are facing a great deal of confusion as a result of these common names. The greatest problem of course will be with 911 on having two streets with the same name, in addition to having two subdivisions very similar in name. It is my understanding that for some reason, Highpointe at Riverhill is being required to file a re-plat. If so, this is to respectfully request that the city take measures to have a name change on both the subdivision and the streets. If no re-plat is required, the Court still requests that the City take steps to eliminate this confusion. As stated, our primary concern is with emergency response on 911.
