This proposal is addressed to the Texas Department of Cotrmunity Affairs, which administers these funds Lander the Dnergency Shelter Grant Program (ESGP). Victims of domestic violence/sexual assault are an eligible target population under the ESGP. We are writing to request your assistance in complying with the proposal guidelines, namely the environmental impact study and the necessary documentation fran the County CEO stating the project will take place in Kerr County. Please refer to the attached l~avironmental Review Checklist. According to the note at the bottan of the sheet, if all answers are negative, no environmental review is necessary. We believe all of our answers will be negative; however, your approval is necessary to ascertain this. Thank you for reviewing the attached information. We do need this approval as soon as possible. Funds may not be obligated or expended for activities in projects that have not been environmentally cleared. ESGP funds distributed by the State to units of general local government will require the unit of general local government to assume the environmental responsibilities specified in section 104(9)(1) of the Housing and Community Development Act of 1974. The State wilt be responsible for providing a release of funds in accordance with the requirements of 24 CFR Part 58. Funds distributed by the State to nonprofit organizations will require the State to assume the environmental responsibilities specified in section 10419)<1) of the Housing Community Development Act of 1974. HUD will provide the release of funds in this instance. In either 'case, funds may be obligated or expended only after the Request for Release of Funds and Certification of compl.fance with environmental regulations at 24 CFR Part 58 has been approved in writing. The 1990 ESGP-RFP packet includes an Environmental Review Checklist (Attachment F) which is designed to assist TDCA in determinfng the ~levei of assessment necessary to meet the requirements of 24 CFR Part 58. Projects will be determined as either <1) exempt or (2) categorically excluded from NEPA reguirements, or in a limited number of instances, as <3) projects requiring environmental impact statements. The Environmental Review Checklist Host be signed by the Chief Elected Official (3), the cooperating local government may conduct the technical review and TDCA would Independently evaluate the Information submitted and subsequently assume all NEPA responsibilities.
