Get Petitions signed- 100 qualified voters within district or more than 50 Y, of district 1. Petitions must show: a. That the District is to 6e created and operated under the provisions of article III, sect. 48-D, of the Texas Constitution. b. Name of the proposed District, i.e., "Kerr County Rural Fire District No. 1" c. Designation of the proposed District 6y metes and bounds. d. That none of the land encompassed is within any other District. e. Mailing addresses of each petitioner and at least two petitioners would guarantee 3150.00 for expenses incurred in the election process. [I. Present signed petitions to Kerr County Judge. III. Public Hearing: Petitions filed with County Clerk 6y County Judge. 1. Clerk issues notices about the hearing, to 6e set by thm County Commisslaners Court. a. Notices will include the following things: 1. The District is to created under the Texas Constitution. 2. The name of the proposed District. 3. Designated boundaries as stated in the petition. 4. The Place, Date and Hour of the Hearing. 5. That all interested persons are invited to attend. 2. Notices are to 6e posted at Courthouse door 20 days prior to the hearing and in lac al newspaper once a week for two consecutive weeks, with the first appearing 20 days prior to the hearing. The County Sheriff is in charge of posting these notices but it will be up to the petitioners to see that it is done properly. 1 3. At the hearing, all interested persons may speak, either far themselves or by their attorney, on all issues relevant to the petition. The Court has jurisdiction to decide all issues. 4, The Court will then have the power to either grant or deny the petition. IV. Election: If the petition is approved by the County Commissioners Court, an election will 6e held. The election will 6e held not less than 30 nor more than 60 days after approval of petition. Notices are to be sent out in the same manner as in the hearing as to date, place, and time of election. V. Submit written request to Ingram City Fathers far consent far Ingram to be included in the District. They will have no more than 60 days to respond. If denied: 1. Petition 6y Ingram voters to be included. Have no more than 30 days after the original 60 days for City Fathers decision. 2. If the Ingram governing body refused to act on the petition, after six months, consent and approval is implied. VI. If majority of voters vote for the District, the Commissioners Court shall order the District official]y created. VII. If created, the Commissioners Court will appoint the Board of Fire Commissioners (5). 2
