M. during Executive Session. ~qg9~ r Mr. George West addressed the Court on the clearing oŁ public road easement by the County without the owners consent. Mr. Harris, Mr. West's Attorney, says that a Right of Way and an Easement are different, and the County can not go in and arbitrarily clear and easement. Stan Reid, Assistant County Attorney, disagrees and says a Right o2 Way and an Easement are the same. We are in a Unit Road System and how to maintain the road is designated to the Road Engineer as long as he does not violate a court order. The presumption is that the Road Engineer, Gerald Menefee, used all his engineering information to make the decision to clear the road easement. Mr. West still contended that the County had no right to clear the easement and he ask that the County cease any further work in the entire subdivision. He further stated that at a time when he could be present, he wanted the ditch replaced and put back where it was, and the dirt returned. He also wants to be reimbursed for the 590.00 attorney fee for an outside attorney, since the County Attorney's Office ..__ did not satisfy him with the answers he wanted.
