On this the 12th day of November 1991, upon motion made by
Commissioner Holekamp, seconded by Commissioner Oehler, the
Court unanimously approved by a vote of 4-0-0, to pay the
Texas Department of Public Transportation 543,582.00 for the
proposed work on the Lane Valley Bridge Project.

THIS AGREEMENT, made this 15th.day of October 1991, by and between Kerr
County, Texas, hereinafter called the "County", Party of the First Part, acting by
and through its Commissioners Court and the State of Texas, hereinafter called the
"State", Party of the Second Part, acting by and through its Texas Department of
Transportation Commission.

incidental items within the limits at Guadalupe River on County Road No. 280, which
is solely the County's responsibility and the County has requested the State to
construct or have constructed this work. The State will construct or have
constructed this work for and on behalf of the County and at the County's sole
expense, including preliminary engineering. The estimated construction cost of this
work is Forty Three Thousand Five Hundred Eighty Two and No/100 Dollars ($43,582.00),
including contingencies and construction engineering.
NOW THEREFORE, it is understood that this proposed work will be constructed by
the State and the County will transmit to the State with the return of this
agreement, executed by the County, a warrant or check made payable to the Texas
Department of Transportation in the amount of Forty Three Thousand Five Hundred
Eighty Two and No/100 Dollars ($43,582.00), to be used in paying for the proposed
work required by the County. It is further understood that the State will construct
only those items for the County as requested and required by the County and the
entire cost of such items, including preliminary engineering, will be borne by the
County. If the State elects to receive bids and if upon receipt of bids by the State

and/or the actual construction and/or approved changes in the contemplated
improvements it is found that this amount is insufficient to pay the County's
portion, then the County upon request of the State will forthwith supplement this
amount by an amount equal to the County's full estimated or actual share of the cost
of this work less the amount previously paid to the Texas Department of
Transportation. In the event the amount as paid is more than the actual cost, then
the excess amount will be returned to the County. It is further understood that the
work to be done on behalf of the County, as herein provided, will include the cost of
contingencies and construction engineering.
IN TESTIMONY WHEREOF, the parties hereto have caused these presents to be
executed in duplicate on the day above stated.

Dear Judge Stacy:
As you know the Lane Valley Road Bridge project is scheduled for letting in
October 1991. Therefore, we request that the County remit the remainder of
their matching funds that are required prior to letting. The amount
required is $46,577.00.
This figure was determined by the following compensation.
Construction Costs of 20% Bridge $ 438,414.80
Preliminary Engineering 46,970.00
Total $ 485,384.80
County's 20% of $485,384.80 = $ 97,077.00
Less Previously Collected 50,500.00
Funds Needed Prior to Letting $ 46,577.00

Attached find two copies of a proposed agreement covering [he part of
Lane Valley County Road that requires 100% participation of the County.
This agreement needs to be executed at your earliest possible time since
the contract for this project will be let on October 8, 1991. A warramt
for the amount shown in [he agreement and made payable to the Texas
Department of Transportation should be forwarded in accordance with the
terms of [he agreement.
Both copies of this agreement should be returned and when executed by the
State the duplicate original will be returned to you for your files.
A "strike out" has been made on paragraph two on the first sheet. Please
initial this chanage when executing this agreement.
