CONTACT: DR S Please be advised that you are released to proceed with the acquisition of right of way and the adjustment of utilities on the above captioned project. We are furnishing two (2) prints of the right of way map for your use, as well as two (2) prints of the metes and bounds description for each parcel needed. In order to assure that construction funds will not be withheld, it is necessary that all right of way be acquired in compliance with applicable State and Federal regulations governing same. A part of the Federal t_aw requires all property owners and tenants occupying property being acquired for right of way purposes to be advised of the Relocation Assistance Program. In compliance with the above, our State policy provides for a Relocation Advisor to advise the occupants of the program, This applies to tenants as well as property owners. While landlords and their attor- neys may protest this action, we have no option under law,. A letter offering Relocation Assistance should be delivered to the occupant on each parcel within seven (7) days after the offer has been made to the owner of the property. This will be handled by our Right of Way Agent, since it is our responsibility to comply with Federal requirements relative to Relocation Advisory Assistance. The Advisor will be glad to be of assistance at any time and may be contacted at this office. In an effort to simplify the Relocation Assistance work, we are attaching hereto a copy of suggested procedures to follow which will allow us to fulfill all of the Relocation Assistance requirements. Belvin District Right of Way Supervisor CDW:ewb Attach. a/s Suggested Procedure to Follow in Connection with Relocation Assistance on County Negotiated Property on C.R., F.M. and 90-10 Highway Projects. 1. As soon as possible after the County has made their first contact to negotiate they should notify the State Department of Highways and Public Transportation by immediately furnishing the District Office with a copy of the Offer Letter. (NOTE: ON PARCELS THAT INVOLVE DISPLACEES THE DISTRICT RIGHT OF WAY SECTION MUST BE NOTIFIED APPROXIMATELY THREE (3) WEEKS PRIOR TO THE COUNTY CONTACTING THE OWNER). 2. The County should also immediately advise the State Department of Highways and Public Transportation of the name and address of any tenant occupying the property. 3. After negotiations have begun on County Roads or Farm to Market Highways, the County should provide the State Department of Highways and Public Transportation with a list of the advertising signs that are to be treated as personal property of the sign owners on the property to be acquired. 4. The County should again notify the State Department of Highways and Public Transportation on each parcel when the deed is signed or, in the case of eminent domain proceedings, when the award is deposited in the registry of the court. 5. The County should also notify the State Department of Highways and Public Transportation on each parcel the date that the transaction was closed or the date that the final judgment was filed in emi- nent domain proceedings. In those cases where a displacee is involved it will still be the State Department of Highways and Public Transportation's responsibility to provide the displacee with written notice allowing them at least 90 days to vacate the pre- mises. A copy of this letter will be furnished to the County so they can cause the parcel to be vacated on the prescribed date. If the above procedure can be followed, it will prevent some of the confusion that otherwise might occur. ~ Q. The Court understands engineering is complete and "Right-of-Way" procurement can proceed. The concerns of the Court is the alternate bridge needed to move traffic during construction. It is our understanding that a temporary bridge will be built for the duration of construction and then destroyed. Kerr County does not have unlimited funds to spend on a temporary bridge to be used and then destroyed or worse "Lost in a flood". Kerr County wants to participate in the project as it will give residents on Lane Valley a bridge that will accommodate loads of 10,000 pounds or more. These residents have no other route to or from their property to receive supplies. Commissioners' Court is willing to work with the State on an alternate route or temporary structure to be used during construction, but would appreciate their concern of Tax Dollars used for temporary bridge.
