(CAG) respectfully request a place on the Court's Agenda for February 28. 1991. We request approximately 20 minutes to present our opposition to what we understand will be a request for a "Variance" to the Kerr County Rules for Private Sewage Facilities (KCRPSF) by Ms. J. Holmes. We believe the request for a "Variance" should be rejected for the following reasons: 1. If approved, the "VARIANCE" would connect two separate residences and Subdivisions to a single Private Sewage Facility. which is contrary to the KCRPSF. 2. There is current litigation pending before the Justice of the Peace Court #1, concerning and alleged violation of KCRPSS, 3. Residents in Cedar Ridge and Glen Oaks #3 object on the grounds that it violates the KCRPSOF and the deed restrictions, 4. The Community Action Group Inc. membership objects. see attached resolution. Helping Conserve Hill Country Living. February 19, iS91 ENVIRONMENTAL HEALTH POLICY STATEMENT CAG Inc.'s members are primarily residents of Kerr County Subdivi lions. And like the residents of the 30 plus other subdivision in Kerr County we have a vita] interest in deed restrictions and the protection of the Environmental Health of the beautiful Hill Country. our most valued asset! The most basic requirements of subdivision living is adequate water and Private Sewage Facilities. The Rules which regulate Environmental Health are most vital to subdivision residents and to all of Kerr County's residents. While many residents of Kerr County have tens, hundreds, yes even ~~ thousands of acres to live and work on, county subdivision re=_i- dents have from one-half to approximately ten acres to live and eniov life on. Obviously the closer you live to together the more necessary it is to live in harmony with ones surroundings. Thus the need for Rules. Kerr County has good Rules that were put into effect in 1988 and CAG Inc. and other interested group=_ worked with County and State authorities to develop the=_e rules in accordance with State of Texas guidelines and laws. Because of the absolute necessity of having adequately designed. operated and enforced Rules for Private Sewage Facilities in single family residence subdivisions. and because of the si€nifi- cant financial impact on property and home owners if the Facili- ties are allowed to degraded. it is the policy of CAG ]nc. to: (1) Vigorously and aggressively pursue the establishment of adequate Rules for Environmental Health and the strict enforce- ment thereof, (2) Vigorously work to enforce the requirement by the care- ful ot~servation of all construction activities as it relates to new or existing Private Sewage Facilities, their construction and operation in accordance with The Rules. We pledge to the Kerr County Commissioner's Court our strong - desire to assist the Court by working cooperatively and con- structively with the court, and we solicit the courts suggestion and concerns. Similarly we offer our assistance to other F:err County Subdivisions by all of us working together to becoma a state leader in Environmental Health.
