DRDER NO. 20318 MOTION THAT THE COURT TAKE NO ACTIDN ON THE CHANGING OF THE "RULES OF KERR COUNTY, TEXAS FOR PRIVATE SEWAGE FACILITIES" UNTIL MORE INFORMATION IS RECEIVED On this the 10th day of June 1991, upon motion made by Commissioner Morgan, seconded by Commissioner Lackey, with Commissioner's Morgan, Lackey and Holekamp voting TMAYE", and Commissioner Oehler "ABSTAINING", said motion that the Court take no action on the changing of the "Rules of Kerr County, Texas for Private Sewage Facilities" until more information is received was approved by a majority vote of 3-0-1. Mr. Burkett's study group and any other individual or group that has a possible solution are to submit their idea to the Commissioners' Court. and any information or material needed by anyone to reach a solution will be supplied by the responsible party. Inc. urges this Court to give the current Kerr County Rules for Private Sewage Facilities it full support and backing and to provide vigorous enforcement of the same. 1. The present Kerr County Rules for Private Sewage Facili- ties are needed to protect the environment and public health and are based on reason, experience and technical and engineering data and judgments. 2. The motion to throw out the Kerr County Rules" and use only the State minimum requirements, seeks to replace commu- nity judgment with special interest in the guise of simplicity and reduced costs. 3. Why does Kerr County need Rules that supplement the States minimum standards? 4. The State Rules are general guide lines applicable to each of the state's 254 counties. The state rules recognize and allow for its minimum rules and standards to be supplemented by local county conditions. The State in fact encourages local Rules to be supplemented. 5. How did Kerr County arrive at the present Rules for Private Sewage Facilities? (Please note that they are not septic tank rules, septic systems are only one of several methods > 6. An Ad-Hoc Committee was appointed representing the various community interest. This group of Kerr County citizens studied the needs of Kerr County and with expert consulting engineering assistance developed the basic Rules we now have. 7. What are the significant factors influencing Kerr Coun- ty's need?-- We have 15-18 years of experience with septic sys- tems and this experience has demonstrated that domestic household waste find their way to the Guadalupe River. 8. New technology for processing on-site sewage has become available in Kerr County that not only purifies the effluent but it also conserves water. 9.
