MOTION 'T'HAT MR. R. C. SUBLETT GRANT KERR COUNTY
AN ADDITIONAL THREE (3) FOOT RIGHT OF WAY ALONG
THE LENGTH OF CARDINAL HILL ROAD, SECTION 1
AND IN RETURN KERR CDUNTY WILL FENCE SAID
RIGHT DF WAY, FENCE BOTH SIDES OF THE RIGHT OF WAY
IN SECTION 2, PURCHASE AN ADDITIONAL
THIRTY (;.30) FOOT RIGHT' OF WAY, PUT A SLEEVE UNDER
THE COUNTY ROAD SO MR. SUBLETT CAN RUN PIPE UNDER
THE ROAD TO HIS LAND ON THE OTHER SIDE, AND
INSTALL TWO (2) GATES
On this the 18th day of April 1991 came on to be considered
by the Court the pending litigation of Sublett vs. Kerr
County. After consideration and on motion made by
Commissioner Oehler, seconded by Commissioner Lackey, the
Court unanimously approved by a vote of 4-0-0 that if Mr.
Sublett grants Kerr County an additional three (3) 'foot right
of way along the length of Cardinal Hill Road, Section 1, the
County in turn will fence the right of way on the West side
in Section 1, fence both sides in Section 2, purchase an
additional thirty (30) foot right of way for S2, 000. 00, put a
sleeve under the County road so Mr. Sublett can run a pipe to
his land on the other side, and we will place two (2) gates
in the fence.
