ORDER NO. 201b1 FINDINGS IN REFERENCE DEPUTY CONSTABLE, JUSTICE PRECINCT #1 On this the 21st day of March 1991, upon motion made by Commissioner Holekamp, seconded by Commissioner Lackey, the Court unanimously approved by a vote of 4-0-0 the following findings and entered the following Order: IT BEING FOUND by the Court that: 1. On the 8th day of May 1989, Commissioners' Court approved the appointment of Jan Michael Skowron as Deputy Constable of Precinct Number One, subject to the Guidelines for Deputy Constable attached hereto as Exhibit A. 2. That said Guidelines authorized the Deputy Constable of Precinct Number one, "to aid the Constable of Precinct Number One only for an emergency, or as needed basis witt. approval from Justice of the Peace, Precinct Number One on service of citations, warrants, etc. as directed by the Constable of Precinct Number One or Justice of the Peace, Precinct Number One" 3. That said Guidelines further prohibited the Deputy Constable of Precinct Number One from wearing any "side arms" during office hours except for "transportation of persons to and from jail, court and arraignments only if necessary". 4. That the Court has received reports that Mr. Skowron has taken additional employment with a local bailbond firm and has used the office of Deputy Constable in the performance of the duties of said additional employment including as justification for carrying a side arm and in taking, on one occasion reported, a person into custody. That any use oŁ office of Deputy Constable for private purposes or in excess of the authorization granted by the Guidelines is specifically not authorized and is in violation oŁ the Court's Order appointing Mr. Skowron. This conduct, iŁ true, was performed without the knowledge or consent of Kerr County, Texas, or oŁ the Constable, Precinct Number One. Such conduct does not represent any policy of Kerr County, Texas, or oŁ the Constable, Precinct Number One, and iŁ true, is hereby condemned. IT IS THEREFORE ORDERED that: 1. The Constable of Precinct Number One investigate the allegations and iŁ he finds probable cause to believe the allegations regarding the conduct of mr. Skowron, to immediately revoke Mr. Skowron's authorization to serve as Deputy Constable oŁ Precinct Number One, Kerr County, Texas. 2. The Justice of the Peace, Precinct Number.One, conduct an investigation into Mr. Skowron's conduct both as Deputy Constable and as Civil Clerk oŁ Justice of the Peace, Precinct Number One, to determine iŁ he has used either office to further his duties as an employee of a bailbond company and iŁ so, to take whatever steps necessary to terminate his employment with Kerr County, Texas. 3. Pending said investigations that Mr. Skowron be counseled by the Justice of the Peace, Precinct Number One, and, if presently serving as a Deputy Constable, by the Constable of Precinct Number One, as to the restrictions upon his activities under said Guidelines and his responsibilities as a public servant. 4. That the Justice of the Peace, Precinct Number One and the Constable of Precinct Number One, present their findings to the Court on or before the expiration of 30 days for further consideration and action, if necessary, by this Court. 5. That if any adverse personnel action is taken as a result of Mr. Skowron's conduct he shall be entitled, by written request, to a hearing before the Court, in open session, to present any evidence or testimony he feels necessary to clear his name from said allegations. GUIDLZNES FOR DEPUTY CONSTABLE 1. This position is to supplement and aid both the Justice of the Peace Pct.# 1 and Constable Pct. # 1 offices only. The main job responsablitys are for the Justice of the Peace Pct. #1 and to aid the Constable of Pct. #1 only for an emergency, or as-needed with approval from JP-1 on service of citation warrants etc. as directed by the Constable Pct #1 or JP-1. 2. There will be no side arms worn in the Justice of the Peace office during office hours. Exceptions would include: Transportation of persons to and from jail, court and arrainments only if necessary. 3. This position will cover Constable Pct #1 and Justice of the Peace Pct #1 only and is not associated with any-other Law Enforcement agency such as: 1. Kerr County Sheriff's Dept. 2. Kerrville Police Dept. 3. Ingram City Marshal 9. Any-other Constables office 5. Any-other Justice of the Peace office 6. Any-other agency 4. This position pays $1.00, until other wise changed, per year. 5. Jan Michael Skowron's main duty will be Civil Clerk of Justice of the Peace Pct #1. 6. Any schooling necessay for this position will be paid out of the Constable Pct #1 budget and leave time approved by JP-1. 7. If any provision of this agreement is broken, this position will automatically terminate by the authority of JP-1 or the Constable Pct #1 only. No other notice will be given.
