unanimously approved by a vote of 4-0-0, ORDER NO. ~O ~~ RELATING TO THE ESTABLISHMENT OF THE KERR COUNTY FIRE PROTECTION ADVISORY BOARD On this day come on to be considered the matter of the establishment of the KERB COUNTY FIRE PROTECTION ADVISORY BOARD and the Court found that: WHEREAS, Kerr County has, under Chapter 352 of the Texas Local Government Code, the authority to provide fire protection to the residents of the county who live outside municipalities; and WHEREAS, Kerr County provides this service through contract with the City of Kerrville, Texas, and various volunteer fire departments; and WHEREAS, Kerr County desires to ensure that the services provided are efficiently provided, are of the highest quality possible, and at the lowest possible cost to the taxpayers; IT IS THEREFORE ORDERED that: I. There is hereby created the KERB COUNTY FIRE PROTECTION ADVISORY BOARD, hereinafter "BOARD". 2. The BOARD shall be composed of seven members as follows: a. The Fire Chief of the City of Kerrville, Texas. b. A County Commissioner to be appointed by the Commissioners' Court for a term of two (2) years. c. Five citizen members to be appointed by the Commissioners' Court, staggered terms of three (3) years each. 3. The initial BOARD shall be composed of: a. Raymond Holloway, Fire Chief, City of Kerrville, Texas. 1 b. R. Gordon Morgan, County Commissioner, to serve until December 31, 1992. c. Citizen Place #1: Eugene Haufler, to serve until December 31, 1994. d. Citizen Place #2: Hans Guldmann, to serve until December 31, 1996. e Citizen Place #3: Michael Hughes, to serve until December 31, 1994. f. Citizen Place #4: ,loe McPhail, to serve until December 31, 1996. g. Citizen Place #5: Eric Lowenthal, to serve until December 31, 1994. 4. The appointed County Commissioner shall be the presiding officer of the BOARD and should function in a neutral, informative, and administrative position. 5. The guide for appointments to the BOARD should be persons who are experienced in business and/or in executive corporate experience with knowledge of fire services. 6. Members of a contracting Volunteer Fire Department are ineligible for service on the BOARD. 7. The BOARD shall have such duties and powers as set forth below and such other duties and powers as may be conferred upon it by the Commissioners' Court: a. Initiate a Study of the condition of the fire protection system in the county and make recommendations on how it can be improved. b. Initiate a Study or series of studies on the effectiveness of the various volunteer fire departments with which the county contracts and make recommendations on: i) the geographical boundaries of the various service areas; i i) Minimum training requirements; iii) an inspection policy for the volunteer fire departments; iv) coordination in provision of fire protection between the various fire departments including a centralized command and control structure; v) coordination of available training for all fire departments; vi) standards for financial accounting and financial reporting procedures; and vii) a performance standard for volunteer fire departments. viii) study of applicable insurance and recommendations. c. Initiate a Study or series of studies on the effectiveness of non-contracting volunteer fire departments and other groups and make recommendations on: i) improvement of the effectiveness of those departments and groups; i i) the coordination and integration of the various non-contracting volunteer fire departments and other groups into the county's fire protection system; and iii) the feasibility of including members of non- contracting volunteer fire departments and other groups into a county wide training program. d. Such other recommendations as the BOARD feels will improve and enhance the level and quality of fire protection in Kerr County. 8. The BOARD shall not have any authority whatsoever to make recommendations directly to volunteer fire departments nor shall it attempt to direct the manner or means by which such department engages in the actual provision of fire protection services. 9. The BOARD shall, however, ensure that all contracts with the volunteer fire departments are being complied with and shall establish a notice and hearing procedure for investigating any potential violations. The BOARD may be retired or abolished upon the majority vote of Commissioners' Court or a majority vote of the BOARD whenever their goals or purposes seem to be fulfilled or no additional accomplishments are feasible.
