and WHEREAS, the United States Constitution, Article I, Section 2, requires reapportionment of the United States congressional districts following the decennial census; and WHEREAS, pursuant to Article V, Section 18, of the Texas Constitution, and Article 42.001, et seq., Texas Election Code, V.A.C.S., and in the belief that fair and equal government requires periodic reapportionment on the County level, including the reapportionment of County Commissioners Precincts and modification of the various election precincts contained within the geographical confines of County, and WHEREAS, the State of Texas is subject to the federal Voting Rights Act of 1965, (42 U.S.C. 1973c), as amended, and 2 WHEREAS, such Voting Rights Act is applicable to the County Commissioners Court of COUNTY NAME County, and to any changes in the standards, practices or procedures applied to all such related precincts, and WHEREAS, in effecting the process of reapportionment, the application of numerous federal and state constitutional, statutory, and case law requirements must be considered, and WHEREAS, it is the express intent of the Commissioners Court of COUNTY NAME County, Texas to fully comply with all legal requirements for the reapportionment of the respective Commissioners Court Precincts, together with any incident election precincts contained with said County, and WHEREAS, it is the express intent of the Commissioners Court of COUNTY NAME County, Texas that each resident of COUNTY NAME County have equal access to all political institutions of this County, State and Nation, and WHEREAS, in order to achieve this stated goal, reapportionmentofthe various Commissioners Court Precincts and the various election precincts within COUNTY NAME County appeared, after careful assessment, to be required; and be it further RESOLVED, that taking into consideration the demographic profiles and statistical studies available to the Commissioners Court, the formerly existing political boundaries which distinguish each respective Commissioners Court Precinct be altered and amended, and that new political boundaries be adopted which comply with the mandate of federal and state law, and which will result in more balanced representation for all residents of COUNTY NAME County, Texas, both in terms of the number of residents therein as well as in ethnic representation, and be it further RESOLVED, that the Commissioners Court herein adopt such boundaries as are more specifically set forth on the incorporated Maps and supporting documentation labeled as EXHIBIT A, in as many pages as may be presently or later annexed prior to submission to the Department of Justice of these United States, which are by this reference incorporated into the body of this Resolution as if set forth herein verbatim; In many eases, county voting districts had been drawn in a manner which did not follow a census block boundary. This required the State of Texas, acting in conjunction with the Slate Data Center and the Texas Legislative Council, to move the actual voting district boundary to coincide with a nearby census block boundary for tabulation purposes only. Several of the suggestions made by Commissioners proved to be unworkable, due to population imbalances. I have attempted to comply with the spirit of the suggestions while addressing population balance (one person one vote) consideration as well as minority representation issues. On these topics you will note a deviation of only 0.18° under the initial suggestion. However, despite some rather extreme adjustments, I was unable to create a reasonably compact, contiguous minority precinct. I would like to discuss this with you if possible. I would like to visit again with the commissioners on July 8, 1991 at 9:00 a. m. Could you arrange for a special meeting of the Conuclissioners Court on that date?
