KERR COUNTY ON RF'RIL 18, 1991 On this the 2nd day of December, upon motion made by Commissioner Oehler, seconded by Commissioner Holekamp, the Court unanimously approved by a vote of 4-0-0~ to consider the matter of the Order of the Court memorialixiag the oral offer of settlement made to R. C. 5ublett in his suit against FCer-r County concerning Cardinal Hill Road and after reviewing the facts it is the finding of this Gourt that the offer dated April 18, 1991, was rejected 6y Mr. S~.iblett and that at least one counter-offer was made by Mr. Su6lett subsequent to his rejection and that other negotiations were entered into between the parties after the offer. Further, it is the ~-- finding of this Court that all GRGE N89 negotiations failed when Mr. Sublett constructed a gate across the road in question in violation of his agreement with the County. There was no need, therefore, to formally withdraw the offer since it ter^minated by operation of law and by the conduct of the par^ties and the termination of the offer- prior to the attempted acceptance by Mr. Sublett is her-e by ratified. If any such offer, or part thereof survived it was through mutual mistake of the parties.
