ORDER N0. 20946 APPROVAL OF CLOSURE OF SOLAR HILL ROAD IN KERRVILLE COUNTRY ESTATES SECTION TWO On this the 26th day of P~iay 1992, upon motion made by Commissioner Holekamp, seconded by Commissioner Lackey, the Court UNANIMOUSLY APPROVED BY A VOTE OF 3-0-0, to approve the closure of Solar Hill Road in Kerrville Country Estates Section Two: May 6, 1992 Commissioner Gordon Morgan Kerr County Courthouse Kerrville, Texas 78028 Dear Commissioner Morgan: RE: CLOSING OF SOLAR HILL ROAD Our Property Owners' Association approached you and Mr. Odom, County Road and Bridge Engineer, in the past in re- gard to the closing of Solar Hill Road to the public. The road has been the source of many problems to the local residents and since it dead ends onto a cul-de-sac, is not pertinent to local through traffic. Mr.Odom seemed to be in favor of closing the road to the public and thus the county would not have to maintain it, if we would do the paperwork to get this project underway. We have contacted the three property owners involved and all have agreed to the closing provided. a pipe gate could be installed and they would be provided with a key. The Property Owners' Association members cleaned up trash along the road and at the cul-de-sac a month ago. We are now requesting that the Com- missioners' Court act upon the closing of Solar Hill Road to the public. Attached you will find copies of the letters from the property owners involved in this matter. If you need any additional. information, please feel free to contact our President, Olan Mahlmann, ~~~= X245 or Secretary, Mary Rodelander 896-5596. Thank you for your cooperation in this matter. MR: ENC. COPY: Mr. Leonard Odom Yours truly, _~ Mary L". Rodelander, Secretary BOARD OF DIRECTORS Kerrville Country Property Owners' Association P. 0. Box 1664 Kerrville, Tx. 78029-1664 ~~ `~' ~ - January 23, 1992 Mr. Carroll C. English ~ ~ 1 z~~, ~r...~-7 ~ 7 3~ . ~~ . ~/ l..s •~ cf ~8a-~ ~~~. G~ T,y~ 7 ~fl Dear Mr. English: ~ LOT# 35_,_SECTION II KERRVILLE COUNTRY ESTATES The Board of Directors of Kerrville Country Property OT~rners' Association, Inc. and Kerr County Officials would like to close Solar Hill Road to the public. Mr. Menefee who was the previous Kerr County Road and Bridge Engineer started working on this project before he left Kerrville. The present Kerr Country Road and Bridge Engineer, Mr. Odom is in favor of this but has asked us to do the paper work. Solar Hill Road is never travelled except for illegal purposes. The County picked up 12 tons of debris there almost eighteen months ago. The road is used for illegal dumping on your property, teenage beer parties, and last summer there was a "drug-bust" at the cul-de-sac. So you can see that it is a constant source of trouble. We would like to "uii-dedicate" the road to the County, put a gate or some barrier at the intersection of Solar Hill Road and Kerr. Country Drive and let it become a private road for use only by the three property owners adjacent to the road and cul-de-sac. The County has informed us that they cannot clean up debris on the private property at the cul-de-sac so it will be your responsibility to keep it clean in the future. At present there is a great deal of trash accumulating there. We would appreciate an immediate response to this letter so that see may proceed with this project. Thank you for your r_ooperation. If you have any questions, please call Olan Mahlman, 512-257-4245 or Mary RodFlander, 512-896-5596. February 13, 1992 Mary Rodclander Secretary Board of Directors Kerrville Country Property Owners' Association P O Box 1664 Kerrville, Texas 78029-1664 Dear Ms. Rodelander: I appreciate your prompt response to the questions 1 raised in my previous letter. If the County will completely clean existing trash (accumulated on the site during the time the road was open to the public] and will also bear the full cost of installing a sufficient barrier, as stipulated in your letter of February 5, 1992, I will agree to closing Solar Hill Road to public access. Thank you for your courtesy. I would like to be kept informed of future developments concerning this issue. Sincerely, S. Holmes, Account No. 136651, Forfeited Account No. 426-91407 Dear Ms. Rodelander: Thank you for your February 5, 1.991 letter. We are i.n the process of reselling the tract that you have been discussing. You should direct your inquiries and questions to the new purchaser, Gregory E. Holmes. His address is listed below. I believe you have the right tract this time. There is some language in the legal description of the property that indicates it includes the rights to "Solar Hill" road. I am forwarci.incl your corresponc]ence to Mr. Holmes. Since he is going to purchase the tract, he will have to approve and cooperate in your attempt to "un-dedicate" Solar Hill Road. We will have to review any agreement he makes with you, but from what I have seen, we would approve it. You may wish to wait until Mr. Holmes completes his purchase and has a contract of sale of record before you get him to sign any agreement. We are in the process of sending him the contract. By copy of this letter I am advising Mr. Holmes to contact you. You are both welcome to call me if you have any questions.
