Item No. 2.10 On-Site disposal system. I would like this Court to grant a variance exempting me from the rules and regulations for an on-site sewage disposal system. Charles Tremper, II addressed the Court saying that in 1991 this property was not platted. The permit was denied because it was unplatted. This property has two different types of soil on 12 acres of land. David stated that he had talked to him of the different types of soil. Commissioner Nbrgan said he would recommend you get with J. P. # 2 and either do as the court order requested or extend your court order. Do what ever is necessary to satisy the Court order rendered. Whatever is worked out then come back to the court with the findings. In May of 1991, I completed and filed an application with Kerr County Environmental Health Department for a permit to construct a private sewage facility on a ten (10) acre parcel of land and was denied the construction permit by David L. Litke, Director of said department. Mr. Litke advised me he would not issue a permit to construct but that he did require one, one thousand gallon, two-compartment tank with adequate drainfield. Having already moved a mobile home on the parcel of land and with no other means of shelter for my family, and being a master plumber for some five (5) years, I complied with Mr. Litke's requirements. Mr. Litke has now filed suit against me in the Justice of the Peace Court in Precinct 2 for installing a septic system without a permit to construct and using a septic system without a license to operate. For the above reasons, I would like to be heard by this Court and be given the opportunity to present photographs and supporting documentation at the time of hearing, if a hearing is granted by this Court.
