Gentlemen, Jack and Terry Koenig are owners of a ten acre tract situated at the intersection of Coker Road and Bushwack Road off Upper Turtle Creek Road. The ten acre tract is commonly known as Tract B-6 of Turtle Creek Ranch Estates which is a subdivision that did not go through the formal platting procedure and which was created several years before active enforcement of any state or county subdivision regulations. The Koenigs' daughter, Jackie, will soon marry Jesse Maldonado and they are to live on the northern portion of the ten acre tract. The Koenigs' live on the southern portion of the tract ( see attahed drawing). Jackie and her husband will receive water from the Koenig s well. Due to the rocky conditions of the site, Jessie and Jackie plan on installing an aerobic system with spray irrigation. There are no near by neighbors and the sprinkler heads are to be installed on the far side of a cedar break away from the house. When applying for the permit to construct the system, Jessie was told a variance must be acquired as this tract is not a platted lot. The spot where the new house sits fronts on an established roadway ( Coker Road ) with existing electrical service. The Koenigs' and the Maldonados' do not which to cut up the tract at this time and perhaps not at all. We ask that the court allow the issuance of this permit and that the court also consider giving a blanket variance to all tracts within Turtle Creek Ranch Estates. The subdivision is not platted but it is a subdivision with large well established tracts which would be required to meet the remainder of the wastewater disposal regulations.
