With these examples have been requests to determine; (1) if the land must be platted, (2) if it is exempted or excepted from platting, (3) if variances may be granted from platting, (4) if permits can be issued before a decision is rendered concerning platting. To reduce the number of requests brought before the Court, I would recommend the following not necessary to be reviewed and or require mandatory platting (Platted means subdivisions approved by the County and recorded with the County Clerk): All divisions of land not platted prior to January 1, 1984, the effective date of the Kerr County Subdivision Regulations. 2. Divisions of unplatted land that front existing roads that do not meet the definition of Section 1 of the Subdivision Regulations. This is further supported by Attorney General Opinion #JM-1100. 3. A division of land into only two parts that complies with item #1 and #2. Multiple division requires platting. 4. Divisions outside the Extra Territorial Jurisdiction (ETJ) of Kerrville or Ingram that also comply with items #1, #2, and #3. Any other divisions of land must be reviewed and considered by the Court in light of statutes, orders, ordinances, regulations, that may affect the development of the property such as sewage disposal, water supply, floodplain, ingress/egress, 911, etc. Any property that is platted or replatted other than a correction plat (clerical error) must be reviewed under the provisions of Chapter 8 Subdivisions of the Rules of Kerr County for Private Sewage Facilities. If the Court approves of this I would also ask for Order #20254, and #20262 to be rescinded, repealed, or modified as appropriate. ejg Enclosures ~ Recycled Paper RULES AND REGULATIONS Regulating the Filing for Record of Subdivision Plats and Establishing Construction Standards and Other Requirements Pertinent thereto for all Subdivisions Situated Outside the Jurisdiction of an Incorporated Town or City in Kerr County, Texas, and Subject to the Jurisdiction of the Commissioners Court of Kerr County, Texas. THE STATE OF TEXAS COUNTY OF KERB It is ordered by the Commissioners Court of Kerr County, Texas, on this 19th day of December, 1983 that effective January 1. 198x, the following Rules and Regulations be adopted listing requirements precedent to the acceptance of plats of subdivisions for filing for record in Kerr County, Texas. Section I GENERAL PROVISIONS The owner or owners of any tract of land situated in Kerr County outside the corporate limits or extraterritorial jurisdiction of any incorporated city, who may hereafter divide the same, excluding land for agricultural use, in two (2) or more parts foe the purpose of laying out any subdivision of any such tract of land, or for laying out suburban lots or building lots, streets, alleys, parks, or other portions intended for public use, for the use of purchasers or owners of Lots in any such tract of land, must comply with the following rules and regulations. •Condominium Projects of more than four (~) units shall be platted and filed and otherwise comply with the provisions of Y. A.T. S. .4rt. 1301a. Section II PURPOSE OF REGULATION The purpose of this Regulation is to provide for the orderly, safe and healthful growth of the undeveloped areas within the County and to promote the health, safety, morals and general welfare of the community. Section Iii D EFIN IT10NS For the purposes of this Regulation, the following terms, phrases, words and their derivations shalt have the meaning ascribed to them in this section: 3.01 Alley: A minor public right-of-way not intended to provide the primary means of the access to abutting lots, which is used for vehicular service access to the back or sides of properties otherwise abutting on a street. -1- Honorable Pamei K. We do not think it necessary to ~~address here whether the term as used in the language "subdivision of the tract, including an addition" in section 232.001(a) might mead more specifically a "planned develop- ment." Whether given divisions constitute "subdivisions," or "additions," or the laying out of "suburban" or "building" lots would probably involve questions of fact such that the issue would have to be approached on a case-by-case basis. S U M M A R Y Under Local Government Code section 232.001(a) a division of a tract of land outside the limits of a municipality into two or more parts -- whether the division be to lay out a subdivision, addition, or suburban or building lots -- is subject to the platting requirements of the subsection only if the division is also to lay out streets, alleys squares, parks, or other parts of the tract intended to be dedicated to public use or for the use of purchasers or owners of lots fronting on or adjacent thereto, as provided in the subsection.
