Since 1981 residents of thesz subdivisions have complained repeatedly about the smell and unsightly conditions that they have had to e~:periance in their homes and neighborhoods. This compilation of authoritative data by the Kerr County Environmental Health Department and the UGRA is a continuing effort by Kerr County Citizens and CAG Inc. to identify the p•ioblem and to s:=.ek community action to correct and to reduce tha pollution. Gn April 20, 1981 the Community Action Group Inc. fil?d a formal complaint with the Texas Department of Health against Kerr County Commissioners' Court for alleged failure to enfol-ce Kerr County Rules for Pri~~~ate Sewage Facilities. Tha Department conducted an audit from July 19`?1 to December 1991. By letter from the Direc- tor, Water Hygiene Division, Texas Department of Health, to Judge W. G. Stacy, Kerr County Commissioners' Court wa.s in instructzd to prepare new Rules and Regulations for On-site LJastewater Facilities. A s;:~ecific item of the audit was The inclusion of the use of soil groupings to determine the system szlection is strongly recommemded"_ (emphasis added). In Junes of 1991 Kerr County Commissioners' Court, as a part of an ongoing effort to change existing Kerr County Rules for On-site Wastewater Facilities, passed an Order stating that it would take no further action until tl-~e Court Had recieved the recommen- dation of the of Burkett Study Group, CAG Inc. and the Department of Health, Region 6, Uvalde, and other citizen groups. From July 19`1 to early January 1992, the following groups drafted their particular set of Rules to meet the needs of Kerr County from each ones' perspective: (1) a group of business and professional men under the leadership of Mr. Joe Burkett, (2) the Texas Department of Health Office Region 6, Uvalde, and (3) the Community Action Group Inc. as consumers. Each of these groups submitted their proposed set of Rules and Regulations for Kerr County On-site Sewaga Facilities in early January, 1891. In mid January the Commissioners reviewed the various proposed rules and agreed to have the Assistant County Attorney to work with persons from each of the three groups and to present back to the Court a composite single sat of Proposed Rules. Such was done and on January 2i~, 1991 the Comrnis•sioners' Court voted (3 for and two abstaining) to post the January 24, 1`~>'~2 act of Proposed Rules for public comment . 2 On February 14, 1992 the County Judge's office issued, on a limited basis, an alternative version of the January 24, 1992 version. The title page carried a notation indicating that the alternate set of rules were prepared by Judge W. G. Stacy and Commissioner- Bruce Oehler with a date of February 18, 1992. This alternate set of Rules consisted of 22 revisions or deletions which changed the substance and effectiveness of tha January 24, ~iUles . PURPOSE..., The purpose of the balance of this compilation is to show from public records that Kerr County soil is generally inadequate to treat bacteria contained in convectional septic effluent. Data presented herein has been compiled from basic public records of the UGRA and Karr County Environmental Health Department. These data ar-e presented in the section of this report entitled "Resource Data". F.i.nd,.ngs. These data show four major population areas in Kerr County that have a history of seep areas where domestic pollu- tion/contamination are found. These are areas of the County that have high density housing in County subdivisions. The areas are identified in the Map~~ as figures: (1) Kerrville South Subdivisions, ( 2 ) Green~•~ood Forest Subdivisions, ( 3 } Oak Forest South Subdivision and (4) Vicinity of Ingram. Tables 1 , 2, 3, and 4 present the data. on the chemical analysis of samples collected by e~:perienced personnel from established sites of known contaminated seep areas in the Gounty. The four components listed are those g=~nerally accepted as identifying seeps that contain domestic wastewater. The Tables show the level of contamination, expressed as "Index°. Ingram vicinity 3988 =~ Pollution Index = Cond.+Cl+So4+Fecal These data show that domestic wastewater is migrating through the sail, and ground ~•~ater, and surfacing at selected seeps. Virtual- ly all the samples show a significant amount of domestic waste leaving the properties ofi home owners in the area. There is a. preponderance of evidence showing that migration of domestic waste and its subsequent occurrence in the seeps and drainage 3 areas are occurring. Additional and earlier data show that pollution problems have existed since 1978. The current spate of seeps has been occasioned by the rain however, there have been four precious seasons with similar experiences. Conclusion The data in this report shows that Kerr County soil is inadequate to properly treat conventional septic tank effluent. This soil inadequacy produces pollution in neighborhoods, homes, the Guadalupe River, and potentially adversely affects health in the County. Secondly, the data support the inclusion of "Guide to Soil Suitability for On-site Wastewater Systems For Kerr County, Texas" in the January 24, 1992 Rules and Regulations for On-site Se~~~age Faculties. Such inclusion will make the applications of TDF-1 Construction Standards Sec_ 301.13 - Design Standards for Effluent Disposal Systems" and Tables IV, V and VI easier to apply to Kerr County soils. Further, the use of the "Guide" will permit each property owner to make the maximum economic use of his property for on-site sewage disposal. 4 -~ab1~5 1-r~ Table 1.
