Gentlemen, Al West is the owner of a 10.84 acre tract of land being the west half of Tract No. 14 of the unrecorded Jack A. Hall subdivision in Kerr County, Texas. It is situated at 190 Scenic Hills Road located approximately 3/4 mi. west from Hwy. No. 16 1/2 mi. north of I.H. 10. We have submitted to Mr. West at this time a proposal for a spray irrigation wastewater disposal system with chlorination, filtration, and an NSF approved Class One Aerobic System which meets the current County and State Standards for On-Site Sewage Facilities. We do not wish to replat the tract due to the time and expense involved in this process. The installer, Guadalupe Wastewater Company is ready to begin construction now, however, the notification process for replatting takes 30 days after the replat has been submitted, reviewed, and placed on the agenda. This subdivision contains 63 Tracts which will mean a generous expense; approximately $300 for certified letters to all land owners and in addition the cost to replat the tract including surveyors fees, filing fees, and county review will be around $1000. We feel the strict enforcement and interpretation of section 5.02 (k) of the above referenced rules are a hardship to the owner and that our proposal is in harmony with this development.
