LOCAL AGREEMENT PURCHASE OF JWENILE SERVICES STATE OF TEXAS COUNTY BEXAR 1. This Contract between the GRANTEE, the Alamo Area Council of Governments (AACOG) and the County of Kerr , a participating county, is in accordance with provisions of the Governor's Office, Criminal Justice Division (CJD), Grant titled "REGIONAL PURCHASE OF JUVENILE SERVICES". The GRANTEE applied for said grant in behalf of participating counties to purchase needed services for alleged and adjudicated juvenile offenders to aid the COUNTY in providing the resources necessary to enable juvenile courts and probation departments to comply with the Juvenile Justice and Delinquency Prevention Act. 2. The GRANTEE is responsible for closely monitoring the SERVICE PROVIDERS and the participating counties and the exercise of reasonable care to enforce all terms and conditions of the grant. 3. Requirements of the Uniform Grant and Contract Management Standards (UGCMS) promulgated pursuant to Texas Civil Statutes, Article 4413 (32g), are adopted by reference as part of this contract, including the contract provision as in Attachment O, item 14, of the above standards. The GRANTEE shall keep all project records and assist the SERVICE PROVIDERS and the County in establishing adequate records input to the GRANTEE for required reports. The SERVICE PROVIDERS and the County will provide the GRANTEE with records input required for exercising the GRANTEE reporting requirements to the State Criminal Justice Division. 4. The COUNTY will furnish the following to the GRANTEE: a. A monthly programmatic report from the local Juvenile Probation Official outlining details of activities related to the program; number of juveniles for whom some type of service was purchased. The goal of this report is to identify the number of youth served by type of service provided and assuring grant compliance. b. A monthly Request for Reimbursement - Purchase of Juvenile Services report outlining services provided detailing unit costs; i.e. service provided, name of provider, date(s) of services, the cost, and if under a contract on file. The purpose of this report is to detail the services provided and the cost of such services. For the Request of Reimbursement to be complete, a copy of the bill describing the services must be attached. When signed and certified the report will serve as the request for reimbursement of funds from the GRANTEE in accordance with the contract between the GRANTEE and SERVICE PROVIDER. c. A copy of OFFICIAL JUVENILE PROBATION REPORT submitted to the Texas Juvenile Probation Commission detailing overall activities of the Juvenile Probation Department of each county. d. Any additional report as may be required of the GRANTEE by State Criminal Justice Division. All reports are due no later than 15 days following the end of the report period to: Alamo Area Council of Governments, Criminal Justice Programs, 118 Broadway, Suite 400, San Antonio, Texas 78205. 5. The GRANTEE will furnish the County: a. A copy of each type of executed SERVICE PROVIDER contract and a list of the SERVICE PROVIDER by type of service. 6. Payment to the SERVICE PROVIDER will be the responsibility of the COUNTY in accordance with normal and acceptable methods practiced by the COUNTY. 7. Reimbursements for the services delivered will be made to the County by the GRANTEE in accordance with paragraph 4 and as soon as possible upon receipt of reports cited in paragraph 4 above and funds from the State Criminal Justice Division to effect payment. If possible, such reimbursement from the GRANTEE will be accomplished within thirty (30) days of receipt of reimbursement request. The GRANTEE will in no way be liable for payment prior to receipt of funds from the State. Billing between the SERVICE PROVIDERS and the COUNTY will be provided the same as would be provided to institutional purchasers in the absence of a grant and shall consist of a brief statement of the service or other item provided and the basis for the billing rate. 9. In the event of a default of any SERVICE PROVIDER, the GRANTEE may cancel or suspend the contract and the SERVICE PROVIDER shall be entitled to recover for all services provided prior to the cancellation date or shall repay any funds advanced for services not yet rendered as approved by the GRANTEE and the COUNTY. 10. All licenses, legal certifications, or inspections required for the services, facilities, equipment, or materials, and all applicable state and federal laws and local ordinances must be complied with by the SERVICE PROVIDER. Failure to comply with this requirement shall be treated as a default by the SERVICE PROVIDER. 11. This contras shall automatically ter. .late on the grant expiration date or any extension or continuation thereof granted by CJD. All services billed hereunder must be rendered within the grant period. 12. Services covered under this contract are enumerated in Attachment #1; Governor's Office, Criminal Justice Division maximum rate schedule revised May 1992. 13. All guidelines, rules and regulations of the State Criminal Justice Division govern the execution of this contract. 14. If any legal action arising under this contract, the laws of Texas shall apply and venue shall be in Bexar County. 15. This contract may be terminated by: a. The County giving written notice to the GRANTEE by March 1 of the year of the COUNTY'S intent not to participate in the "Regional Purchase of Juvenile Services" the following grant year. Thus this agreement would be automatically terminated the following August 31 of the year of notice. b. The GRANTEE giving written notice to the COUNTY by March 1 of any year of the GRANTEE'S intent not to be the grant applicant in behalf of the COUNTY in the "Regional Purchase of Juvenile Services" the following grant year. Thus this agreement would be automatically terminated the following August 31 of the year of the notice. 16. Regardless of the signatory date below, this contract is effective only on the issuance of a "Statement of Grant Award" for the aforementioned grant program by the State of Texas Criminal Justice Division of the Governor's Office for which AACOG as the GRANTEE will make annual application for continuation in behalf of the County until notified to the contrary.
