STATE OF TEXAS § LEASE AGREEMENT COUNTY OF KERR § This Lease Agreement is made and entered into this day of February, 1992, by and between DOWNTOWN PROPERTIES, hereinafter called LANDLORD, and KERR COUNTY, hereinafter called TENANT. LANDLORD leases to TENANT Suites #103 through #104 (1280 sq. ft.) of a commercial building known as the DOWNTOWN EXECUTIVE CENTER located at 327 Earl Garrett Street, Kerrville, Texas. The terms of this lease shall be month to month, commencing April 1, 1992. TENANT agrees to pay LANDLORD the sum of $700.00 per month, plus a prorata share of the monthly utilities. Rent is due and payable on the fifteenth (15th) day of each month. TENANT shall operate the leased premises for the use and purposes of County Offices continually during the term of this Agreement. TENANT agrees not to Sub-Lease any of the leased premises without the written consent of the LANDLORD. LANDLORD , at his expense, shall maintain the roof, foundation, and structural soundness of the exterior walls and common areas. TENANT shall maintain the interior of the leased premises in good repair and condition and shall keep the interior free from waste and nuisances and shall return the leased premises to LANDLORD in good repair and condition, reasonable wear and tear excepted. LANDLORD shall pay all ad valorem taxes assessed against the building and improvements and keep the building insured against loss of damage by fire, tornado, and extended coverage to include loss by wind, storm, hail, and explosion. TENANT agrees that LANDLORD has no responsibility for any damages which might occur to the contents of the building. If TENANT shall allow the rent to be in arrears more than fifteen (15) days after notice of such delinquency or shall be in default under any condition of this lease for a period of thirty (30) days after written notice from LANDLORD , or should any other person than TENANT secure possession of the premises or any part hereof for any reason, LANDLORD may, without notice, terminate this lease, or in the alternative LANDLORD may re-enter and take possession of the premises and remove all persons and property therefrom without being deemed guilty in any manner of trespass, and re-let the premises or any part hereof, for all or any part of the remainder of such term, to a party satisfactory to LANDLORD, at such monthly rental as LANDLORD may be able to secure.
