I, Sandra Burger was asked to organize and hold an open horse show in conjunction with the annual Kerr Co. Fair. The festival committee, believing they had full use of all of the youth exhibit center and grounds, assumed the horse event would be covered under their insurance policy. They were informed by an insurance carrier that a clarification needed to be made on the outdoor arena, (which had been classified as Hill Country Property, not County} before both areas could be covered under one policy. I asked Shirley Bell to help coordinate the Horse Show. Her responsibilities, among others, included verifying insurance coverage. I turn the floor over to her. I, Shirley Bell, found these areas in question during the planning of the show: 1. Who owns the property ("County", or "Hill Country")? In regards to insurance purposes and accessibility, concerning the 4H horse club lease (both indoor and out door arenas)=in accordance to the 1955 deed restrictions in volumes 97 page 445, and volumes 144 page 178, states clearly that no sale or lease of property was allowed to occur within 25 years or property would revert back to the Hill Country Development Foundation (but 4H was granted a lease in 1964). The conveyances stated the right to use for park and other recreational activities, and especially for agricultural purposes. In the 4H lease (court #9832) it states clearly that the facility was to be used for 4H and FFA exclusively, which is not in accordance with the conveyances as stated .above. (this property was paid for by bonds started in 1955. Kerr County Boys Livestock Association built a large part of the Ag building with money donated by private citizens, for all citizens use, according, to court # 7881) We believe that since our taxes paid for this property, no one should have exclusive rights to its use. Everyone should have access to its use in accordance to its original conveyances - these are the terms in which it was voted on in 1953. 2. Why has the 4H lease been exempt from reverting to County property, as other approved buildings have? 3. What is the fee the county has approved for the rental of the facility? Where does the money go, to the county? It should be distributed as the county sees fit in accordance to the conveyances. In accordance to Court #12352, the last approved rental increase for the agriculture exhibition building was $50 per day, effective March 10, 1975. The air conditioned one third of the building had an approved rental charge to $110 day, and $50 per day for private use (court #17954} the rates excluding youth organization (court #16366). How can 4H sublease county property, and collect fees? 4. Clarify or define "Youth Organizations" and "City of Kerr", or 45t'ounty Organizations". These organizations are exempt from ar~y charges as recorded in county records (court #16366). 5. The priority of use of these facilities, as documented in the county records, all youth, county and city organizations have priority over paying patrons according to the conveyances. Until these discrepancies have been clarified, we will not affiliate ourselves with the use of the facilities. We do not want any repercussions by association, nor do we want to contribute to any wrongful doing or act. If we are considered a youth organization, since over 700 of our riders are youth, we would like to please book the following dates: Sat. Oct. 30 1993 in Sat. Feb. 19 1994 Sat. April 30 1994 Sat.
