SUBJECT: Consider exempting governmental entities from fees for on-site sewage
facilities and floodplain permits
A decision is requested from Commissioners Court to consider whether or not to
continue exempting governmental entities from permit fees.
Attached is Order #17746 and supporting letter from the Upper Guadalupe River
Authority stating current policy.
If the court wishes to continue exempting entities, I would ask that all
governmental entities: Federal, State, County, City, local, and their political
subdivisions be exempted from on-site sewage facility fees (except for State
Research Council Fees) and from floodplain development fees.

REQUEST OF TEXAS PARKS & WILDLIFE DEPARTMENT FOR DECISION BY
THE KERR COUNTY COMMISSIONERS' COURT CONCERNING SEPTIC SYSTEM
FEE EXEMPTION
On this the 18th day of February 1988, came on to be considered
the request of the Texas Parks & Wildlife Department for a
policy decision by the Kerr County Commissioners' Court, as to
whether or not their agency would be exempt from the permit fee
requirements concerning Septic System Regulatory Program in
Kerr County.
Upon motion made by Commissioner Ray, seconded by Commissioner
Holland, with Commissioners Holland and Ray and County Judge
Edwards voting "AYE" and Commissioner Lich voting "NAY", said
motion carrying by a majority vote, approving exemption of fees
only for. septic systems installed on government property by or
for a governmental agency. For purposes hereof a "Governmental
Agency" means an agency of the Federal or State governments and
Counties and Municipalities.
