Kerrville Hills Ranch Estates No. 1 is a platted and recorded subdivision in Kerr County dated June 8, 1971. -~ 3. Lot 25, across Loma Vuelta Road from this lot was replatted in February, 1,989. 4. This 1'ot is in City of Kerrville ETJ and subject to their subdivision ordinance, which were in effect June, 1971, since they signed the 5 original Kerrville Ranch Estates No. 1 plat. 5. I don't think the "grandfather" concept applies to a platted subdivision. ~6. Please give me a letter with your opinion before the September 7, 1993 Commissioners' Court meeting. Enclosed herewith please find a photocopy of a plat and field notes prepared by Dellie Voelkel in 1982. The situation is basically as follows: 1. I purchased 1/2 of Lot 18 of Kerrville Hills Ranch Estates (3.5 acres) in 1982. I am in the process of reselling the 3.5 acres, without change. Technically, I am grandfathered under the County Subdivision Regulations. 2. The property is in the extra territorial jurisdiction of the City of Kerrville, but city staff have indicated that I am also grandfathered under their subdivision regulations. 3. There is a complete separate city ordinance, however, which deals with the issue of installing taps into the city water system. The water system in Kerrville Hills Ranch Estates is a part of the city water system. This separate ordinance requires that no tap or meter can be installed on a lot which is not platted. 4. Larry Vetter and Joe Maceiras have therefore indicated that I am going to have to plat the 3.5 acres, not because of the subdivision regulations but because of the water tap ordinance. Both Larry and Joe have indicated that the city has what is called a "minor platting process" whereby only my 1/2 of the original lot will need to be platted and the plat can additionally be signed off by city staff without need of going through the full planning and zoning platting process. 6. They have also indicated that David Litke will need to sign off on the plat for the county wa_th regard to the ability ~o place a sewerage disposal system on the property. Accordingly, I s~equest that at the Commissioner's Court Meeting we fully inform the Commissioner's Court of this situation and request approval for the following: 1. That the county grant a variance to its subdivision regulations or acknowledge that this tract i.s, in fact, grandfathered under the subdivision regulations. 2. That the county grant a variance such that the full Chapter 9 review process for sewerage disposal sites will not need to be used with regard to this lot (as recommended by David Litke). 3. That. the Commissioners give David Litke permission to sign off on the plat and that a sewerage disposal system in accordance with county regulations can, indeed, be placed on the property {if, of course, it actually meets those requirements).
