The predatory animal control program conducted under the temts of this agreement shall be under direct supervision of the Animal Damage Contrd Program, Animal and Plant Health Inspeaion Service. A local representative will consult frequently with the Cooperator relative to_the extent d the Confrol~Agencies participation, plans and procedures necessary to best serve the interest~oi the parties hereto. 2. The Cooperator will provide funds to the Texas Cooperative Trapping Fund for the empbyment of personnel and payment of mileage necessary to conduct official duties. The Contrd Agencies will pay the balance of the salary, travel costs and all other necessary expenses to effectively carry out the pn~gram. 3. The State Director of the Texas Animal Damage Contrd Program or designated official will cerfiry, as to correctness, all claims to be paid by any parry to this agreement and shah perform such other administrative functions as are agreed upon from time to time; provided, that no funds of the Cooperator will be transferred to any such employee working under the terms of this agreement. 4. Statement of Assurance in compliance with 43CFR 17 of the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252) is hereby mutually agreed to by all parties. 5. Furs or other parts of monetary value taken from wild animals will be handled in accordance with the provision of Article 3 f. of the Memorandum of Understanding. 6. This agreement and any continuation thereof shalt tie contingent upon availability of funds. It is understood and agreed that any monies allocated for the purpose of this agreement shall be expended in accordance with its terms and in the manner prescribed by the fiscal regulations and/or administrative policies of the control agency making the funds available. 7. Th;s agreement shall continue in force and effect until superseded or terminated. Terms and financing may be reviewed and revised periodically and confirmed by correspondence. It may be amended by mutual agreement and may be terminated by either party upon thirty (30j days written notice. NOW, THEREFORE, Pursuant To Section 2 Above, It Is Mutually Agreed That: 1. The Control Agencies shall furnish supervision of the project and shall provide equipment and other supplies required in the operation of the project. 2. The present amount of $1250 per month that you now provide will increase to $1400 per month for the services of a full time Animal Damage Control Specialist (ADCs). Again, this increase does not take effect until January 1, 1995. We are providing this information to you for future budgeting purposes. Our present assessment of $1250 will have been in effect for three years and four months by the time of the increase. The projected Cooperative Trapping Fund balance indicates that we must implement this increase or reduce personnel. How long this increase will last will .depend on the future amount of state and federal appropriations provided to the Texas Animal Damage Control Program. This- increase is not reflective of a proportional salary increase for the ADCs. It is necessary because our expenses have exceeded our revenue for some time now, depleting our reserves. This is due to increases in ADCs salary, mileage, and benefit costs over the last three years; fewer state and federal appropriations available to support ADCS positions; and increases in salary, hours worked, and benefits for secretarial support at some of our District Offices. The new assessment will provide approximately 50$ of the cost of an ADCs. During your consideration~af-this change, keep in mind that your county may also be receiving substantial aerial hunting services and/or the services of other program personnel, at no extra cost.
