On behalf of the Kerr County Commissioners' Court we have requested an opportunity to present at this meeting our request for your approval of city participation in development of a new animal control facility, which we will attempt to design, build and have operational prior to July 1, 1995, that date upon which the Freeman-Fritts facility will no longer accept impounded animals. The basis for the county's proposal is the notion that it will benefit Kerr County, as well as the City of Kerrville and the City of Ingram to have one county facility used by all three entities, rather than to have each government build, equip and staff three separate facilities. We are requesting the council's approval of the proposed contributions to development of the county's facility, which includes your commitment to contribute land and sewer facilities, as well as appointment of a councilperson(s) and/or staff member(s) to a committee which will meet in the immediate future with similar representative from the county and the city of Ingram to work out the remaining details regarding the construction and operation of the facility, as well as the terms and conditions of the intergovernmental contract pursuant to which this new facility will operate. The county's proposal can be broken down into two interrelated parts. The first deals with the design and construction of the physical facilities. The County is requesting that the City of Kerrville contribute approximately 1 lj2 acre of land (exact dimensions to be worked vut by the committee and submitted to the council for approval) that is located as shown on the attached map. This land would be deeded to the county, and the facility (see proposed plans, also attached hereto) would be built on that land. This is land currently owned by the city which is adjacent to the proposed extension of Legion Drive and abutting a portion of the land which Recor, Inc., has purchased for development of their new juvenile detention facility. The property is currently zoned for agricultural use, which zone also specifically permits animal control facilities. In addition, the county requests that the city provide the necessary sewer lines to serve the animal control facility. The county will contribute the construction of the facility and necessary appurtenant structures, such as the parking lots and driveways, etc. At this point, we estimate that the facility will cost approximately $150,000.00 to construct. The second part of the proposal deals with the operation of the new facility. The benefit that the City of Kerrville will receive in return for its contribution is a substantial reduction on the rate that it would otherwise be required to pay for use of the facility over a period of time, that would be roughly proportionate to the value that it contributes to the development of the physical facility. There would also be the additional intangible benefits to the city of increased services for the rate currently being paid (the plans for this facility include increased hours of operation from those offered by Freeman-Fritts) and a 24- hour animal drop-off area, which will permit unwanted animals to be dropped of at the facility, rather than abandoned in the city or county. The proposed committee would also be responsible for reaching an agreement on specific valuation of the land and sewer connections to be contributed, as well as how to distribute this contribution over time as a rate reduction for the city. We contemplate that if our plan is approved by the council, the appointed committee members will meet promptly to determine various specific details having to do with completion of the facility, such as the exact dimensions and location of the land to be donated by the city, how the intergovernmental contract for operations is to be worded, approval of the final design, and so forth. Given the time constraints under which we are operating, we expect that the final design plans and going out for bids will take place simultaneously with the committee working out the details of the intergovernmental agreement for operations. 2 While we recognize that we are requesting a significant contribution of value from the city towards this project, we believe that in the long run it will substantially benefit the citizens of Kerrville far in excess of the value of this contribution, and will foster improved relationships between our two governments.
