Date: July 26, 1994 Subject: Status of Knott Road We have been waiting on a legal opinion from the County Attorney regarding the status of Kerr County Road & Bridge working on the road easement known as Knott Road and spending money on same when this road is not a county maintained road. Some of the questions concerning this road are: a) Can Kerr County Road & Bridge spend money on a county road which has not been accepted as a county maintained road by the Commissioners' Court. b) Roads brought into Kerr County maintenance must meet certain requirements, which include width ofright-of--way, condition of road, drainage, road obstructions, etc. This road easement meets none of these requirements. We are aware of certain problems involving neighbors in this area, however this should not involve the Ken County Road & Bridge Department. This road has been in place since the early 1950's, in fact, before Mr. Spenrath built his house adjacent to it. If these problems are not resolved, and if laws are broken, perhaps they should resolve their dispute in a courtroom of proper jurisdiction. CC: County Attorney
