" Road & Bridge has been approached by Ingram Little League (ILL) and Texas Department Of Transportation (TOOT) to construct a drive from what was Old Highway 39 at the Hill Country Arts Foundation to the little league field. At one time Precinct 4 used the area for stockpile material, but as best I can tell it was never maintained as a road. When the State relocates a road they usually deed the old roadway back to the landowners or to the County. However, last year when there was a question about the property just across Hwy 39 on Johnson Creek being used as a stockpile and burn area, we found it was retained by the State. This is the same situation, the State still owns this road, but has not maintained it. TXDOT wishes to put a new entrance for a better angle to Hwy 39 and make it safer. We are in agreement with TXDOT; however, Wayne Phel admitted that the road still technically belongs to the State. Our problem arises since it is not a county maintained road. Should we be doing work for a non-profit organization? The II,L wants us to dig out the driveway and do all of the work. Our normal procedure is to have the driveway constructed by the individual, and we tie it into our roadway with a pipe purchased by the owner. Depending on the location of the ILL driveway, it may or may not be necessary to install a pipe. I believe that we should not be involved with this project. II.L should take care of the problems they created on Hwy 39. State Constitution law prohibits expenditure of county funds if the county does not own or control such property. At this time I ask the Court to clarify their position on this property and road.
