As set forth in the enclBSed letter of intent, we are giving an easement of 30 feet in width and extending 312.5 feet to the North line of old Texas State Highway #27. All new right of ways for roads coming into the Kerr County system of roads should be 40 feet in width. I d® not think this parcel should be considered as a new right of way; inasmuch as it was put into the County Roads system for construction and maintenance back in 19I~8, some 115 years ago. Since this short county road was jtst over- looked when other county r®ads were reported for inclusion in the unified system, it seems only reasonable that it should be handled as coming under "the grandfather clause". Likely other existing county roads which were built, paved and maintained for more than tt5 years were not required to extend their right of ways by 10 feet. This right of way has never been fenced and I'd guess never will be. With as little traffic experienced, maintenance should be light. The following street or road names were given to Mr. Frank Felts in their order of preference: Bethel Way, Hummer Haven, Immanuel Dr. Some other names were deleted as already taken. If further action on my part is needed, please, advise. Since this very short little read, long-standing in the county road system, has served well with a 3~ ft. right of way it is my hope it may continue to do s®. cc: file Sinc, ~1 yours / s~ ~~ Attention Mr. Oehler: A further word may be needed to my letter to you of 2/1/9~t. If my reasoning is not sound concerning this right ®f way as 1 ong standing and not some new work coming into the county road system and therefore under the 30 ft. right ®f way guide- line in practice ~i5 years ago, please, give me a call. Of course I prefer to give the 30 ft. easement, 3s others did whose right of ways were included in the 19~ unified system. BUT... I will not quibble over seven one hundredths of an acre. Should the Commissioners not $ee this as an old roadway and therefore under the earlier guidelines and deserving the same treatment as given those not overlooked, then let me know this. I have checked and was unable thus far, to find a model easement in the County records that I could use. If I am to persue this further, please, let me know. I will be awaiting further Nord from you.
