HILL COUNTRY COURT AP'P'OINTED SPECIAL ADVOCATE "CASA" CONTRACT THE STATE OF TEXAS COUNTY OF t',ERR WHEREAS, Kerr County, Texas ("COUNTY">, a political subdivision of the State of Texas, has the a+_~tharity, thro+_~gh its co+.inty attorney, ~_tnder Section 41.103 of the Texas H+_~man Resources Code, to provide for- services to and s+_ipport of children in need of protection and care; and WHEREAS, the cn+_ir^ts of COUNTY have the authority under var^io+_~s provlslons of the Texas Family Cade to appoint g+_~ar^dians ad litem, or^der^ family studies, and pursue other matters designed to aid the court in the exercise of their d+_~ties regarding childr^en; and WHEREAS, The Hill Co~.mtry Court Appointed Special Advocate, ("CASA"), a Texas; non-profit corporation, is engaged in the provision of s+_ich services to the courts, j+_~venile probation department, and other COUNTY departments engaged i.n the provision of services relating to childr^en, and desires to enter into a contract with COUNTY to cantin+_-e to provide those services to COUNTY and its departments; IT IS THEREFORE AGREED that: 1. CASA will provide ser^vices to the residents of COUNTY as follows: a. Provide g+_tardians ad litem for use by the co~_~r^ts in appropriate cases relating to .j+_~venile matters, and b. Provide family st+_~dies and per^form such other investigations services as requested by COUNTY. ~. Acts of discr^imination shall constit~-te a mater^ial br^each of this contr^ar_t. 5. CASA f~_~rther^ agr^ees to adopt and maintain a policy that prohibits sexual harassment. Acts of sexual harassment constit~_~tes a material breach of this contract. 6. CASA agrees to comply f~_~lly with any and all applicable laws, local, state, and federal, regarding work ho~_tr^s, safety, wages, social-sec~_~r^ity benefits, and/or^ wor^ker^s' compensation. CASA currently has and shall maintain a policy of liability insurance in the following minimum amounts: Premises: Personal Injury 4. CASA agrees to operate under a policy of non-discrimination with regard to the provision of said services. Such policy shall prohibit discrimination on the basis of race, sex, age, religion, color, handicap, disability, national origin, language, political affiliation or belief, or other non-merit factor. Acts of discrimination shall constitute a material breach of this contract. 5. CASA further agrees to adopt and maintain a policy that prohibits sexual harassment. Acts of sexual harassment constitutes a material breach of this contract. 6. CASA agrees to comply fully with any and all applicable laws, local, state, and federal, regarding work hours, safety, wages, social-security benefits, and/or workers' compensation. This clause places a duty to meet the requirements of such laws only if the law itself places such a duty on CASA. Acts in violation of any of those laws or ordinances constitute a material breach of this contract. TERM 7. CASA shall submit to the Ken County Auditor an annual financial report itemizing all income and expenditures for the period covered by this agreement. CASA shall also submit to the Ken County Auditor an annual report which states the total number, listed by court requesting, of children served, of family studies initiated and/or completed, of times appointed and/or served as guardian ad litem, and the number and type of other services performed by CASA along with the name of the department requesting the service. 11. No moneys paid to CASA shall be expended for any purpose other than those specified above. Unless specifically provided for herein, no moneys may be expended for the provision of salaries to any person. 12. All books and records of CASA shall be open for inspection during normal business hours to any member of the public, the Kerr County Auditor, and to such persons as may be given that authority, in writing, by the Kerr county Auditor or the Kerr County Commissioners' Court.
