On this the icth day of December 1994, upon motion made by
Commissioner Oehler, seconded by Commissioner Halekamp, the
Co+_~rt unanimo+_isly approved by a vote of 4-0-0, to approve the
caner^act between CASA and Kerr County.

"CASA" CONTRACT
THE STATE OF TEXAS
COUNTY OF t',ERR
WHEREAS, Kerr County, Texas ("COUNTY">, a political
subdivision of the State of Texas, has the a+_~tharity, thro+_~gh
its co+.inty attorney, ~_tnder Section 41.103 of the Texas H+_~man
Resources Code, to provide for- services to and s+_ipport of
children in need of protection and care; and
WHEREAS, the cn+_ir^ts of COUNTY have the authority under
var^io+_~s provlslons of the Texas Family Cade to appoint
g+_~ar^dians ad litem, or^der^ family studies, and pursue other
matters designed to aid the court in the exercise of their
d+_~ties regarding childr^en; and
WHEREAS, The Hill Co~.mtry Court Appointed Special
Advocate, ("CASA"), a Texas; non-profit corporation, is
engaged in the provision of s+_ich services to the courts,
j+_~venile probation department, and other COUNTY departments
engaged i.n the provision of services relating to childr^en, and
desires to enter into a contract with COUNTY to cantin+_-e to
provide those services to COUNTY and its departments;
IT IS THEREFORE AGREED that:
1. CASA will provide ser^vices to the residents of COUNTY as
follows:
a. Provide g+_tardians ad litem for use by the co~_~r^ts in
appropriate cases relating to .j+_~venile matters, and
b. Provide family st+_~dies and per^form such other
investigations services as requested by COUNTY.
~. This cantr^act is not excl+_~sive, and COUNTY, reserves the
right to contract with add itianal par^ties for the
provision of any and all services covered by this
agreement.
~,. CASA c~_rrrently has and shall maintain a policy of
liability ins~_~rance in the following minim~_~m amounts:

4. CASA agrees to operate ~_~nder a policy of
non-discrimination with r^egar^d to the pr^ovision of said
ser^v ices. Such policy shall pr^ohibit discr^imination on
the basis of race, sex, age, r^el igion, color, handicap,
disability, national or^igin, language, political
affiliation or belief, nr other non-merit factor. Acts
of discr^imination shall constit~-te a mater^ial br^each of
this contr^ar_t.
5. CASA f~_~rther^ agr^ees to adopt and maintain a policy that
prohibits sexual harassment. Acts of sexual harassment
constit~_~tes a material breach of this contract.
6. CASA agrees to comply f~_~lly with any and all applicable
laws, local, state, and federal, regarding work ho~_tr^s,
safety, wages, social-sec~_~r^ity benefits, and/or^ wor^ker^s'
compensation. This cla~_ise place a d~_~ty to meet the
req~_~ir^ements of s~_~ch laws only if the law itself places
such a d~_ity on GASA. Acts in violation of any of those
laws or^ or^dinances constit~_-te a mater^ial br^each of this
cvntr^act.
TERM
7. The ter^m of this agr^eement is one (1) year^ beginning on
October 1, 1994 and ending on September 30, 1995, unless
ear^lier terminated by either par^ty on thirty (3~) days
written notice addressed to:

CONSIDERATION
8. COUNTY agrees to pay to CASH the annual sum of ~50fi.Q~+Zi
for the provision of the services described above.
9. Upon written r^equest, payment shall be made an or^ befor^e
January 1, 1995.

11. No moneys paid to CASA shall be expended far^ any p~_ir^pose
ather^ than those specified above. Unless specifically

provision of salaries to any person.

"CASA" CONTRACT

COUNTY OF KERB
WHEREAS, Kerr County, Texas ("COUNTY"),apolitical subdivision of the State of
Texas, has the authority, through its county attorney, under Section 41.003 of the Texas Human
Resources Code, to provide for services to and support of children in need of protection and
care; and
WHEREAS, the courts of COUNTY have the authority under various provisions of the
Texas Family Code to appoint guardians ad litem, order family studies, and pursue other matters
designed to aid the court in the exercise of their duties regarding children; and
WHEREAS, The Hill Country Court Appointed Special Advocate, ("CASA"), a Texas
;non-profit corporation, is engaged in the provision of such services to the courts, juvenile
probation department, and other COUNTY departments engaged in the provision of services
relating to children, and desires to enter into a contract with COUNTY to continue to provide
those services to COUNTY and its departments;
IT IS THEREFORE AGREED that:
1. CASA will provide services to the residents of COUNTY as follows:
a. Provide guardians ad litem for use by the courts in appropriate cases relating to
juvenile matters, and
b. Provide family studies and perform such other investigations services as
requested by COUNTY.
2. This contract is not exclusive, and COUNTY, reserves the right to contract with additional
parties for the provision of any and all services covered by this agreement.
3. CASA currently has and shall maintain a policy of liability insurance in the following
minimum amounts:

4. CASA agrees to operate under a policy of non-discrimination with regard to the provision
of said services. Such policy shall prohibit discrimination on the basis of race, sex, age,
religion, color, handicap, disability, national origin, language, political affiliation or belief,
or other non-merit factor. Acts of discrimination shall constitute a material breach of this
contract.
5. CASA further agrees to adopt and maintain a policy that prohibits sexual harassment.
Acts of sexual harassment constitutes a material breach of this contract.
6. CASA agrees to comply fully with any and all applicable laws, local, state, and federal,
regarding work hours, safety, wages, social-security benefits, and/or workers'
compensation. This clause places a duty to meet the requirements of such laws only if the
law itself places such a duty on CASA. Acts in violation of any of those laws or
ordinances constitute a material breach of this contract.
TERM
7. The term of this agreement is one (1) year beginning on October 1, 1994 and ending on
September 30, 1995, unless earlier terminated by either party on thirty (30) days written
notice addressed to:

CONSIDERATION
8. COUNTY agrees to pay to CASA the annual sum of $500.00 for the provision of the
services described above.
9. Upon written request, payment shall be made on or before January 1, 1995.
10. CASA shall submit to the Ken County Auditor an annual financial report itemizing all
income and expenditures for the period covered by this agreement. CASA shall also
submit to the Ken County Auditor an annual report which states the total number, listed by
court requesting, of children served, of family studies initiated and/or completed, of times
appointed and/or served as guardian ad litem, and the number and type of other services
performed by CASA along with the name of the department requesting the service.
11. No moneys paid to CASA shall be expended for any purpose other than those specified
above. Unless specifically provided for herein, no moneys may be expended for the
provision of salaries to any person.
12. All books and records of CASA shall be open for inspection during normal business hours
to any member of the public, the Kerr County Auditor, and to such persons as may be
given that authority, in writing, by the Kerr county Auditor or the Kerr County
Commissioners' Court. No clause shall, in any way, be construed to override the
provisions of the Federal Privacy Act or other state or federal law or regulation concerning
the disclosure of confidential or privacy matters.
