Before the minutes of the last meeting were approved, Stephen Drane raised the issue of the Dugosh Aircraft Service lease extension. He advised the Board that Ronnie Kramer with Dugosh had some questions concerning the lease regarding fuel sales. Dr. Davis informed the Board that starting in 1999 his contract states that he will have to be in compliance with current Airport Rules and Regulations on fuel sales which requires that he be open seven days a week. Mr. Drane advised that the EAA Fly-In issue was discussed at the meeting, but not from a contractual point of view. Dr. Davis reminded the Board that Mr. Dugosh is due for a tank inspection in less than two years and could have the tanks removed at that time. Dr. Davis felt that whatever exemptions are already in effect should not be extended to the current lease. Mr. Drane advised that we need to define Dugosh as an FBO or repair facility, and if he is a repair facility he is not obligated to sell fuel according to the lease. Dr. Davis recommended to keep the lease extension as is with wording stating that Dugosh provide fuel for the EAA Fly-In as long as he is in the fuel selling business. The Board agreed to obtain legal counsel on the matter. APPROVAL OF MINUTES Upon motion made by Mr. Drane and seconded by Mr. Davis, the minutes of September 15, 1993, were approved as written. REPORT ON EAA FLY-IN Mr. Gregory reported that the Fly-In was good but not a record breaker due to weather conditions. It was slower than record years although turn out was good. It was estimated there were over 5,000 people in attendance. -1- INCENTIVE LEASE RATES FOR AIRPORT PROPERTY RELATED TO ECONOMIC DEVELOPMENT Staff member Kirk McCarley addressed the Board on incentive lease rates for the airport. Mr. McCarley recommended a starting point for incentive lease rates would be to offer a fixed rate and a fair market lease for properties that abut the runways and taxiways and also a lease rate for those that are not on taxi/runways with an incentive built into the schedule. Mr. Davis inquired if there was a time frame on the rates. Mr. McCarley advised that it is something in place for guidance until such time as it becomes unreasonable for these rates. Ms. Priest asked Mr. McCarley if he had checked with other airports the size as Kerrville's. Mr. McCarley advised that he had not, that this was an incentive package and a reasonable starting point for the airport. Mr. Davis inquired if the City Attorney would have any input. Mr. McCarley advised he had talked to Mr. Machann and a schedule was passed to him and he saw no problem with it. Mr. Davis wanted it stated that the contract should not be bound to the absolute values. Mr. McCarley advised that all prospects would go before the Airport Board for approval. At that time Mr. Drane made motion that the CPI be included in the incentive lease rate schedule for the airport property and make note that land be reserved abutting runways/taxiways for aircraft related industries and every three years be reviewed for adjustment, motion seconded by Mr. Goertz. STATUS OF CURRENT PROJECTS/STAFF REPORT - Mr. Henckel reported that he had a problem with people parking on Al Mooney Rd. and Hwy. 27 during the EAA Fly-In. Mr. Henckel advised the Board that next year to eliminate confusion, a sign could be put up that says free parking with an arrow pointing in the direction of the parking lot, and also put up a no parking sign on one side of Al Mooney Road during the Fly-In. - No news on the ASOS/radio frequency change, waiting for a reply. - Airport of the year sign displayed for the Board, advised that two signs would be erected at the entrance to the airport. - Wildflower seeds have been planted at the airport by Mr. George Hale. All the seeds were donated and a letter of thanks will be sent to Mr. Hale. - Some seal coating finished on Peterson Farm Road, from the bridge to Mooney Aircraft. Mr. Gregory advised the Board that during the EAA Fly-In people were walking over the temporary fence that is erected. Inquired if a permanent fence could be installed. Mr. Henckel saw no problem in erecting a permanent fence but would check regulatory problems. Mr. Drane asked Mr. Henckel if Mr. Bill Minor had contacted him about leasing property at the airport for an ultra-light hanger. Mr. Henckel advised that he had spoke to Mr. Minor and Mr. Minor stated that'he would contact Mr. Henckel at a later date when he had obtained more details. As a result, the TxDOT Aviation Division determined that a portion of the increased funding will be made available for a new Economic Incentive Program to improve air transportation and encourage economic development. We aze soliciting proposals from interested sponsors for projects that have not historically been eligible for funding by the Federal Aviation Administration or the TxDOT Aviation Division and that can be directly linked to economic enhancement of the community through airport development. The Aviation Division will award grants of up to $100,000 on a fifty/fifty matching basis to communities that can demonstrate that a specific project will create tangible and measurable •economic benefits to the community. In order to be considered for participation in this program, four copies of a detailed proposal delineating the proposed project and expected economic returns should be submitted to the Avtation Division no later than 15 February 1994. A Grant Selection committee consisting of program representatives from the Aviation Division staff and a representative from the Texas Department of Commerce will evaluate the proposals, make recommendations, forwazd them to the Texas Transportation Commission for consideration, and notify the selected recipients. The development of a new VOR RWY 17 SIAP has made this proposal necessary. Airspace reclassification, effective September 16, 1993, has discontinued the use of the term "transition area." Designated airspace extending upward from 700 feet above the ground is now Class E airspace. The intended effect of this proposal is to provide adequate Class E airspace for aircraft executing the new VOR RWY 17 SIAP at Hondo, TX. The coordinates for this airspace docket are based on North American Datum 83. Class E airspace areas designated for airspace areas extending 92-ASW-34 upward from 700 feet or more above ground level are published in Paragraph 6005 of FAA Order 7400.9A dated June 17, 1993, and effective September 16, 1993, which is incorporated by reference in 14 CFR 71.1 (58 FR 36298; July 6, 1993). The Class E airspace designation listed in this document would be published subsequently in the Order. The FAA has determined that this proposed regulation only involves an established body of technical regulations that need frequent and routine 4 amendments to keep them operationally current. It, therefore - (1) is not a "significant regulatory action" under Executive Order 12866; (2) is not a "significant rule" under DOT Regulatory Policies and Procedures (44 FR 11034; February 26, 1979); and (3) does not warrant preparation of a regulatory evaluation as the anticipated impact is so minimal. Since this is a routine matter that will only affect air traffic procedures and air navigation, it is certified that this rule, when promulgated, will not have a significant impact on a substantial number of small entities under the criteria of the Regulatory Flexibility Act. ("Lessee"). 1. This Fourth Addendum amends and extends the original lease dated February 10, 1976, the Addendum thereto dated May 1, 1976, a Second Addendum dated September 1, 1982, and a Third Lease Addendum and Extension dated August 26, 1989. 2. Subparagraph (a) of Paragraph 2, "Consideration", of the said original lease is hereby deleted effective August 25, 1999, and the following substituted therefor: 2. CONSIDERATION In consideration of the foregoing, Lessee and Lessor agree as follows: ~:(a) Subject to the provisions herein set out, Lessee agrees to pay to Lessor as rental for the use and occupancy of the leased premises under this lease an amount equal to FIFTY AND NO/100 ($50.00) DOLLARS per acre plus an additional amount equal to the increase (or decrease) in the Consumer Price Index ("CPI") for Urban Wage Earners and Clerical Workers, U. S. Average as published in the Bureau of Labor Statistics annually in said CPI as of the date of this Fourth Addendum and August 25, 1999 provided that such additional amount shall not exceed 20~ of $50.00. The total of $50.00 and the amount of increase in the CPI multiplied times the number of acres contained in the leased premises shall be the initial rent due under the extension of the lease as herein provided and shall be referred to as "Base Rent", which Base Rent shall be due monthly in advance, beginning on August 25, 1999, and continuing regularly and monthly on the same date thereafter during the term of this lease but subject to adjustment as provided in paragraph (b) below. (b) Lessee's Base Rent will be adjusted on August 25, 2004. The increase (or decrease) shall be based upon the Consumer Price Index (CPI) for Urban Wage Earners and Clerical Workers, U.S. average as published in the Bureau of Labor Statistics annually. On August 25, 2004, the Base Rent shall be adjusted based upon the immediately preceding twelve (12) months CPI average to obtain the amount of the increase (or decrease). That amount of increase (or DC170/a:4003.1/HRJ/kj/12/7/93 decrease) in the CPI over the base CPI (the CPI determined as of August 25, 1999, the effective date of this Fourth Addendum) shall be the percentage .increase (or decrease) of the Base Rent for the next five (5) year period. However, there shall be a twenty percent (20~) maximum increase limit of the CPI. In. the event of a decrease in the twelve (22) month CPI Average being used for an adjustment of rent, it is agreed that there shall be no decrease in rent which amounts to the payment of less rent than the initial Base Rent. 3. Paragraph 3, "Term of Lease", of the said original lease as modified by the Third Lease Addendum and Extension dated August 26, 1989, is hereby deleted, and the following substituted therefor: 3. TERM OF LEASE This Lease terminates August 25, 2009. 4. Lessee further agrees to provide fuel for sale and personnel to dispense such ,:fuel to the participants of the Experimental Aircraft Association ("EAA") Annual Fly-In held in the fall of each year at the Kerrville/Kerr County Airport. However, the foregoing obligation as to EAA shall apply only so long as Lessee is selling fuel from the Leased Premises. 5. Lessee acknowledges and agrees that the Lease is subject to present and future Airport Policies and Standards and Rules and Regulations (collectively, "Standards") and that full compliance with all such Standards will be required no later than August 25, 1999. Failure of the Lessors to enforce such Standards shall not result in a waiver, in whole or in part, of any of the Standards or impair the right of Lessors to thereafter en/force the same.
