KERR COUNTY MEDIUM SECURITY k'ACILITY On this the 12.th day of April 1994, upon motion made by Commissioner Holekamir, seconded by Commissioner Oehler, the Court unanimously approved by a vote of 3-0-0, to rescind the Electrical Bid which was given to Design Electric for $33,515.00 and replace with the bid Compton's of Kerrville gave for $33,515.00, with exhibit "A" attached for reason of amending order # 2].912. EXHIBIT A April ].2, 1994 Kerr County Commissioners' Court Project: KERR COUNTY MEDIUM SECURITY FACILITY Re: Electrical Contract On March 22, 1994 the Court received and opened sealed Bid Proposals for work on the above named project. For Division 16 Electrical, there were two taids received: Design E:lectrir of San Antonio $33,515.00 Compton's of. Kerrville 34,480.00 On March ?.3, 1994, the Court accepted the Bid Proposal of Design Electric. On March 24, 1994, I notified Design Electric by letter that the Court had authorized the award of a contract and requested a Certificate of Insurance. On April 5, 1994, I received a form letter from Design Electric signed by a non-principal of the firm offering use of "Or•.cupational Ac;cident and Employees 6:xcess Liability" for $1,000,000.00 as self-insurances in Lieu of Workman's Compensation coverage, I also received a Certificate of Insurance sett:i.ng out the other coverages required by the Specifications. On April 5, J.994, I talked with Mr. Ray Garcia, Project Manager for Design Electric and expressed concern over their not providing Workman's Compensation Coverage and advised him that the County Attorney's Office ruled that since such insurance is required in the SX>ecif:ications, a self insurance plan is not acceptable. He said he would go about getting the required coverage. On April 6, :1994 by letter: I notified Design Electric that each Contractor is responsible for securing permits from the City. Submitted two copies of an Agreement for completion by Design Electric. On April ]. 7., 1994, I contacted Mr. Garcia and asked him if their representative, Tom Jones is an electrician. He responded "yes". I then contacted City Inspections and Tom Jones is not a licensed electrician. Mr. Garcia then gave me the first name of another person anti contact with the City Inspections there was no licensed person known to them to he a representative of Design Electric. On April 12, ].994, I again made phoneralls to Mr. Garr.ia regarding their having a licensed Ma:,ter Electrician in charge of their work on this project - he gave me the name Jim Warhuler, who is not so licensed. I called back, Mr. Garcia said he was mistaken the name is Jim Warhurst - who also is not licensed. In the next call he gave me the name Curtis D. Thompson, wham he said has been in Design F,lectric's employ for two weeks. I then found that Curtis Thompson is a licensed Master F,lectrici.an, however he is employed by the Kerrville State Hospital. In the mattr>r of Workman's Compensation coverage, he said they would attempt to got it, however it would take at least four (4 ) day:; . During the bidding prore:,s, Tam Jones told me that De:;ign Eaectr:i.c was est.abli.shing a local branch office which he would manage. Until not they have only an answering service and an address to leave messages. Because I have worked with Design Eaer.,tric for some 19 days, have been given incorrect informatican, have nothing resolved, and w:i.th the possikaility of still more lost time because it will take at least four days to get their Workman's Compensation coverage, and since time is of the essence in progressi-ng with t.hi.s project, I respectfully recommend that the Court Order accepting the Bid Proposal of Design Electric be rescinded. I further recommend that a contract be awarded to Compton's of Kerrville for Di.vision 7.6, Rlectrical in the amount of 533,51.5.00, payable upon completion and acceptance of the work. /s/ D. R.
