WHEREAS, Travis County operates the Travis County Juvenile Detention Center for the housing of juveniles; and WHEREAS, the Travis County Juvenile Detention Center has been duly inspected and certified as being suitable for the detention of juveniles; NOW, THEREFORE, the parties agree as follows: PURPOSE The purpose of the Contract Travis County Juvenile Detention County of Contractor, referred for indicating a need for supervisic dispositional status or during prescribed by the Court. is to provide housing in the Center for juveniles from the an act of delinquency or an act ~n, during pre-trial and pre- the post-dispositional stay SERVICES Travis agrees to provide-those juveniles housed in the Travis County Juvenile Detention Center, room, board, 24 hour daily supervision, medical screening;-nn••approved educational program, recreational facilities, and counseling in accordance with t}~e Family Code of the State of Texas and other applicable law. Such detention space and service shall be provided by Travis at the request of Contractor. Such space, however, will be provided by Travis to Contractor on a space available basis. in the event Travis reaches its capacity and space is needed to detain Travis juveniles, Travis will contact Contractor to arrange for the immediate transfer of Contractor's juveniles to the custody of Contractor. Contractor agrees that its staff will immediately accept the return of its juveniles and will promptly supply staff members to handle the transfer. Contractor agrees to provide and pay for any necessary emergency examinations, medical treatment, and hospitalization for juveniles from Contractor's county which occur outside and within the Center. Travis is authorized to secure such examination, treatment and hospitalization for juveniles from Contractor's county at the expense of Contractor and to request that Contractor be billed for the same. Travis shall notify Contractor of such emergency within one (1) regular working day of its occurrence. FEES For services rendered under this Agreement, Contractor hereby agrees to pay to Travis the sum of 5130.00 per day per child. Charges will include one day for the day of admittance (regardless of hour of entry) and one day for the day of release (regardless of hour of departure), plus the number of days between the date of admittance and the date of release. This rate of 5130.00 per day per child will be in effect for the term of this contract. ADDITIONAL CONDITIONS When a juvenile is transported to Travis the officer effectuating the transfer should have the following with him: a. A copy of the signed Detention Order. If detention is made during the weekend, on a holiday, or after normal working hours, then the signed Detention Order must be received no later than the second working day after detention. b. A Consent for Medical Treatment form completed by the child's parents or the Juvenile Probation Officer within the Contractor's county. c. A completed Mental and Physical Profile of Child to be Detained form. d. A completed JIS - Child Dpscrintion form. Juveniles placed in preadjudication care in the Center shall be removed therefrom by Contractor, its agents, servants or employees at the conclusion of the 10 day period authorized by Court Order issued by the Judge of the Juvenile Court of Contractor unless a new order has been issued authorizing the continued detention, and a copy of such order has been delivered to the Center. A copy of the order issued pursuant to waiver shall be furnished promptly to the Center. Should a'juvenile in preadjudication care not be removed by Contractor, its agents, servants or employees as noted in above section by 12:00 noon of the 10th day of detention and a new order authorizing continued detention has not been received at the Travis Juvenile Detention Center, an employee of Contractor's county shall immediately and forthwith remove or cause to be removed such juvenile from the Juvenile Center. Should a juvenile in preadjudication care not be removed by Contractor, its agents, servants or employees as noted in above section by 12:00 noon of the 10th day of detention and a new order authorizing continued detention has not been received at the Center, at Travis' discretion, an employee of Travis may deliver the juvenile to the Juvenile Court of Contractor for which there will be an additional'charge of $ .26 per mile. Juveniles placed in the Travis Juvenile Detention Center shall not be removed prior to the conclusion of the Court Order except by authorization of the Contractor's Juvenile Probation Officer or Contractor's delivery of an Order for Release signed by the Judge of the Juvenile Court of Contractor. Travis agrees that the Center will accept any juvenile qualified hereunder, without regard to such juvenile's religion, race, creed, color, sex or national origin. The decision as to whether an out-of-county child will be admitted to the facility will be made by the Travis Assistant Chief of Detention Services or appropriate designee. If a juvenile is accepted by Travis and the child is found to be dangerous or unmanageable, or whose mental or physical health condition would or might endanger either the juvenile or the other occupants of the Center then upon such determination and notification by Travis to the Contractor's Juvenile Judge or Juvenile Probation Officer, Contractor shall immediately and forthwith remove or cause to be removed such juvenile from the detention facility. Staff and visitors from Contractor's county will be expected to abide by all Travis Juvenile Detention Center policies and procedures. A probation officer from Contractor's county will make contact (by telephone or in •personj with each juvenile from Contractor's county at least twice per week. TRAVIS EMPLOYEES Nothing in this Contract shall be construed to permit Contractor, its agents, servants, or employees in any way to manage, control, direct or instruct its servants or employees in any manner respecting any of their work, duties or functions pertaining to the maintenance and operation of the Juvenile Detention Center. TERM The term of this Contract is for a one (1) year period, commencing on the 28th day of Fe~y~~, 19g~4 and terminating on the 28th day of February , 1995. Thereafter this Contract shall automatically renew for successive one (1) year terms unless either party gives the other thirty (30) days prior written notice of its intent to terminate this Contract. 3 INDEMNITY In connection with any services done or offered by Travis under and by virtue of the above and foregoing, the Contractor hereby agrees and stipulates that it will hold Travis, its Commissioners of Travis County, Texas, and the Travis County Juvenile Board, its members, agents, and employees and the Travis County Juvenile Services Department, its members, agents, and employees, free and harmless from any and all claims, assertions, and judgments, whatsoever, arising in whole or in part in connection with such services so offered or carried out hereunder. ENTIRE AGREEMENT This agreement supersedes any and all other Agreements, either oral or in writing, between the parties hereto with respect to the subject matter hereof, and no other Agreement, statement, or promise relating to the subject matter of this Agreement which is not contained herein shall be valid or binding. APPLICABILITY This Agreement shall inure solely to the benefit of the parties hereto and not to any third party recipients or supplier of services. ASSIGNABILITY This Agreement is personal to the parties and is not assignable. ATTORNEY'~9 FEES If any action at law or in equity is brought to enforce or interpret any provision of this Agreement, the prevailing party shall be entitled to reasonable attorney's fees in addition to any other relief to which he may be entitled. GOVERNING LAW The validity of this Agreement and of any of its terms or provisions, as well as the rights and duties of ttie parties hereunder, shall be governed by the laws of the State of Texas. This Agreement shall only be amended by the mutual agreement of the parties hereto in writing to be attached to and incorporated into this Agreement. 4 LEGAL CONSTRUCTION In case any one or more of the provisions contained in this Agreement shall for any reason be held to be invalid, illegal, or unenforceable in any respect, such invalidity, unenforceability shall not affect any other provision thereof and this Agreement shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein.
