WII..LIAMS & ASSOCIATES (STELLA WII.LIAMS) of Kerr County, Texas, herein called "LESSOR," and KERB COUNTY, TEXAS herein called "LESSEE." I, nFC~RrnrION OF PREMISES LESSOR leases to LESSEE, and LESSEE hires from LESSOR, as herein provided, the property located at 604-B Junction Highway, Kemille, Kerr County, Texas. II. TERM The term of this lease is from November 1, 1994 to September 30, 1995. III. $~HT LESSEE agrees to pay LESSOR the amount of $4,675.00 in eleven equal monthly installments of $425.00 each, beginning on November 1, 1994, and payable on the 1st day of each month thereafter during the term of this lease. IV. i7CF OF PREMISES. GENERAL LY The premises are leased to be used for office space, courtroom space and for related activities and for general meetings. LESSEE agrees to restrict their use to such purposes and not to be used for any other purpose, including subleasing, without consent of LESSOR. V. PAYMENT OF UTILITIES LESSEE shall pay all utilities provided to the leased premises, except water and trash pickup provided during the term of this lease. LESSEE shall pay electricity, telephone and any other utility (whether or not listed herein) provided to the leased premises during the term of this lease. VI. REPAIR AND MAINTENANCE LESSEE, at its expense, shall maintain and keep the interior of the premises in good condition and repair. VII. DELiVEK"r`. ACCEPTANCE AND SLiRRFNDER LESSEE agrees to accept the premises on possession as being in a state of repair and in sanitary condition. LESSEE agrees to surrender the premises to the LESSOR in the same condition as when LESSEE took possession, allowing for reasonable use, wear and damage by act of God, including fire and storms. Any redecorating of the leased premises desired by LESSEE during the term of this lease shall be at LESSEE'S expense. All other structural alterations or permanent improvements to the licensed premises shall be agreed upon by LESSEE and LESSOR. VIII. INDEMNITY AGItFFMENT LESSOR shall have no duty regarding locks and window latches, other than to keep existing locks in good repair, subject to LESSEE'S obligation to give LESSOR notice of need for repau of said locks. LESSOR strongly recommends that LESSEE secure its own insurance to protect against all above-referenced occurrences. LESSOR shall not be liable for personal injury, damage or loss of LESSEE'S personal property {such as furniture, equipment or records) from fine, rain, hail, smoke, explosion, sonic boom or other causes whatsoever unless the same is due to the negligence of LESSOR. No insurance will be carried by the LESSOR as to the contents of the leased premises. No premises liability insurance will be carried by the LESSOR on the leased premises. IX. MAINTENANCE OF LEASED P FMI LESSEE shall maintain, during the term of the lease, the leased premises in good order, and repau. LESSEE shall maintain, during the term of the lease, the leased premises in as safe and clean condition as same were in at the commencement of this lease. LESSEE shall be responsible for plumbing stoppages in lines exclusively serving the leased premises and from damages from windows or doors left open. LESSEES shall service heating and air conditioning equipment by changing the air filters on said equipment at least monthly. LESSOR shall be responsible for any other repair or replacement of heating or air conditioning units. X. LEASE APPLICABLE TO r7(''~' 4SnR'S FT(` This lease and the covenants and conditions herein expressed apply to and are binding on the heirs, successors, executors, administrators and assigns of the parties hereto. XI. NOTICE OF MTNATION Either party may terminate this lease by giving thirty (30) days written notice to the other party of its intention to terminate the lease. Xli.
