Mr. Wayne Pehl addressed the Court :>tating there has been a c;uestion raised on whether or not there is a deed to this property and who owns this portion of land that is in <;uestion which is part of the old highway 39, The road there now is the old highway 39 and the plat indicates that this road is a private road. The property was given to the Little League years ago. The state is willing to make an entrance on the west side of road but they could not maintain it. The road and bridge department do not want to maintain it if is private property. Commissioner Holekamp stated the best thing that could he done would be to have the Little League build the fence needed and deed this easement to Kerr County then we in turn could maintain the ingress or egress. OF REVISING CONTRACT ON SALE OF THE G[JADALUPF: SAVINGS B[ILDING AKA KERR COUNTY ADMINISTRATION BUILDING On this the 24th day of May 1994, upon motion made by ~ ^ommissioner Oehler, seconded by Commissioner Lehman, the Court unanimously approved by a vote of 4-0-0, to accept the contract as revised deleting Phase II (9E) with closing date to be August 24, 1994. Kerr County would vacate property within 45 days. Contract could he extended after August 24, 1994 for an additional $10,000.00 earnest money. As of today $1,500.00 is non-refundable.
