On this the 11th day of October- 1994, upon motion made by

Court unanimously approved by a vote of 4-0-0, to apprnve a
part-time position for the Kerr County Extension Office at
45.00 per hour far- 19 hours a weeks funds to come from
Commissioners' Court Contingency and any monies that maybe
left from Jerri Ray's solar-y after^ she r•etir•es in January is
to be credited to Commissioners' Court Contingency.
ITEM 2.5 Consider the development and appointment of a Kerr
County Fire Marshal. (Danny Wooten)
Mr. Wooten addressed the Court with a resume to be County Fire
Marshal and ways the County could benefit from having a Fire
Marshal. The Court was impressed 6y his resume and would like
some time to think about the position. This item is to be
brought back on the October 24, 1994 Ryenda.

VOLUNTEER FIRE DEPRRTMENT CONTRACT
WHERER5, Kerr County, Texas, hereinafter COUNTY, a political
subdivision of the State of Texas, has the authority, under
Texas Local Government Code Sec. 351.001 to furnish fire
protection to the residents of the county who live outside
municipalities; and

WHEREAS, the MOUNTAIN HOME VOLUNTEER FIRE DEPARTMENT,
hereinafter DEPARTMENT, an incor•por^ated volunteer fire
department, desires to enter into such a contract for the
provision of fire fighting services and fire fighting
equipment to said residents of the county.
IT IS THEREFORE AGREED that:
1. DEPARTMENT will furnish fire fighting services and
equipment to the areas served by DEPARTMENT during the last
Fiscal Year.
2. DEPRRTMENT will furnish fire fighting services at the same
level as was provided to its area during the last Fiscal Year.
3. DEPARTMENT will provide personnel that are at least
minimally tt•ained or certified and available for• fire fighting
ser•vices.
4. DEPARTMENT shall, considering DEPARTMENTS commitments to
it's own are, provide back-up emergency fire fighting services
to such other ar^eas of the county as requested.
S. This contract is not exclusive and COUNTY reserves the
right to contract with additional parties for the provision of
fire protection in the area covered by this agreement.
6. DEPRRTMENT agrees to establish a training program far
their member-s to insure a qualified Volunteer Fire Department.
TERM
7. The term of this agreement is ane year beginning on
October 1, 1994, and ending on September ,,@, 1995, unless

CON5IDERRTION
8. In consideration for the provision of fire fighting
services to the residents of COUNTY, DEPARTMENT shall be
entitled to a sum not to exceed 86,@@@.0@. Disbursements from
said amount shall be made only on presentment of receipts to

and approved by the County Auditor for- expenses incur•r•ed in
the provision of such fir^e fighting services including, but
nut limited to gasoline, oil, replacement parts, tr•aininy,
equipment, and insurance.
9. No moneys paid to DEPRRTMENT shall be expended for any
purpose other than for• the provision of fire protection
ser-vices and equipment to residents of COUNTY. No moneys,
however-, may be expended for- the pr-ovision of solar^ies to any
person.

accepted practices, and all books and record of DEPARTMENT
shall be open for inspection during normal business hours to
any member- of the public, the County Auditor-, and to such
persons as may be yiven such author-ity by COUNTY, including
members of the Volunteer- Fir-e Depar-tment Advisory Roar•d.
I1. DEPRRTMENT shall strive to ensure that all of its members
are adequately trained and shall endeavor- to establish a
training program which includes a continuing education
pr•oyr^a m. DEPARTMENT shall pr•epar•e and maintain an individual
training record for• each member showing the training received,
including the subject, date, amount of time and the name of
the instr^uction providing such training. Copies of any and
all licenses, certifications, and course completion
certificates shall also be included in the individual trainine_
r•ecor•d. These r-ecor^ds shall not be open to the extent that
they contain Federal Pr-ivacy Ret matters.

guidelines pr^omulgated by the Texas Firemen's and Fire

14. DEPARTMENT shall submit to Kerr County Ruditor financial
annual report of all expenditures and income for- the period
covered by this agr-Bement.
15. In addition to the consider~atinn set for^th above, COUNTY
agrees to provide wor-leers compensation coverage for each
member of DEPRRTMENT during the term of this contract,
DEPRRTMENT shall pr^ovide to the Kerr- County 7r^easur-er- the
names of each member^ of DEPRRTMENT to be covered by Wor-leers
Compensation and any other information on said individuals as
required by the carrier.
