ORDER NO. 22744 APPROVAL OF LITIGATION SETTLEMENT WITH MATTHEW CARREDN On this the 26th day of June 1995, upon motion made by Commissioner Lehman, seconded by Commissioner- Lackey, the Court voted 3-0-0, to follow the County Attorney's recommendation regarding the payment of f2, 000. 00 to Matthew Carreon as stated in the compromise settlement agreement which follows: PAGE 52 // COMPROMISE SETTLEMENT AGREEMENT 1._ THIS AGREEMENT is by and between MATTHEW CARREON, individually and KERR COUNTY, TEXAS. WHEREAS, MATTHEW CRRREON, was arrested in Bexar County, Texas on December 24, 1995 on a Kerr County warrant of disputed validity and suffered damages as a result; and WHEREAS, bona fide disputes and controversies exist between the parties, both as to liability and the amount thereof, if any, and by reason of such disputes and controversies the parties hereto desire to compromise and settle all claims and causes of action of any kind whatsoever which plaintiff has or may have in the future arising out of such occurrence and intend that the full terms and conditions of the compromise and settlement be set forth in this compromise settlement agreement; NOW THEREFDRE, for and in consideration of the recitals set forth above and the sum of Two Thousand and No/1@@ Dollars (82,@@@.~@>, the receipt and sufficiency of which is hereby acknowledged, plaintiff has this day released and by these presents does release, acquit, and forever discharge KERR COUNTY, their agents, servants, and employees, and employees, and all persons, natural or corporate, in privity with them or any of them, from any and all claims or causes of action of 'y any kind whatsoever, at common law, statutor^y of otherwise, that plaintiff has or might have, known, or unknown, now existing or that night arise hereafter, directly or^ indirectly attributable to the above-described occurrence it being intended to release all claims of any kind which plaintiff might have against those hereby released. It is expr^essly understood and agreed that the terms hereof are contractual and not merely recitals and that agreements herein contained and the consideration transferred is to compromise doubtful and disputed claims, avoid litigation, and buy peace and that no payments made nor released or other consideration given shall he construed as an admission of liability, all liability being expressly denied. ~ _.
