Many times an owner purchases two or more lots, platted or unplatted, with the intent of utilizing both lots for improvements including placement of the drainfield. This creates a problem with possible encroachments, altering the original purpose, of the lots, the need to plat or replat, and requests for variances or appeals to regulations. On the good side the owner is decreasing the density of septic systems, increasing the area for a drainfield, and increasing overall lot area. To overcome the negatives and enhance the positives, I would like to propose the following options: The owner must decide to either (1) plat, (2) replat, (3) locate house, tank, and drainfield entirely on one lot, (4) physically pie the lots together. If the owner choses option #4, then two lots as platted (not divided or a fraction of} must be tied together with a structure that has a permanent foundation (not a tied-down mobile home). across the middle property line. If this is done, then replotting is not necessary and the middle property line is no longer recognized. To accomplish this the owner must further provide the following: Request an exception under Chapter 3 of the Rules of Kerr County for Private Sewage Facilities (Rules) providing documentation is submitted satisfying items #1 through #4. 1. There are no deed restriction violations for the structure and its placement. 2. There is no easement encroachment. 3. There are no other setback violations. 4. If any of the above exist, a letter from the appropriate entity will be required showing no objections for allowing the encroachments.
