APPROVAL OF MINUTES. Cr. McAshan moved, vcconded by Cx. Forbes to approve the minutes of December 1, 1994 as submitted, subject to one minor correction. All voted in favor and the motion carried. DISCUSSION AND CONSIDERATION ITEM. Discussion and consideration of a variance to the nlattinn requirements of the City of Kerrville's Subdivision ordinance. The planning director explained that this property is not within the city limits of the city of Kerrville, but ~.s within its ETJ, so city subdivision ordinances do apply. He then explained that between Contour and Valley V7.ew Drives, there is a large undeveloped, unplatted traot of land. The terrain of this tract is very rough, and is currently used only as a drainage way_ 5 FP.Ot1 PHOt JE N0. FC The planning director then informed the commission that Mr. Stoepel wishes to puxChase approximately 4.5 acres lying behind the block in which his lot is located in order to preclude any development and ps'escrve it as open specs. Therefore, Mr. Stoepel is reques~ing a variance to the subdivision requirements of the Kerrville Subdivision Ordinance. The planning director explained that ordinarily, selling ar leasing a portion of unplatted acreage triggers the gubdivisian process. In this ease, the provision of scrviacs to this tract, should it be platted, would be extremely difficult. He then stated that additionally, the tract will become "land-locked", having no frontage on any public roadway. The planning director then told the commission that given the terrain, and that it is a drainage path, staff concurs with Mr, Stoepel that it is probably not reasonable to expect any development on this 4.5 acre tract in the foreseeable future, and that open apace is its best use. 'Therefore, staff recommends that the variance be granted, provided that Mr. Stoepel include in the recorded deed a restriction preventing future development on this 4.5 acre tract of land unless it iE subdivided in accordance witYi the subdivision ordinance of the city bf Kerrville. After some discussion, Cr. McAshan moved, seconded by Cr. Hamilton to gzant the variance for platting requirements on thus 4.5 acres, subject to staff recommendation as stated above. All voted in favor and the motion carried. SUBDIVISIONS. Discussion and consideration of a final let for Los Cedras Subdivisicn_ located tc the northeast of the .intersection of acxson The planning director slated that he would like to point out that next to the Bluebell Bills Addition, Lots 14 - 19 will be single family development, acrd the balance of the lots will be zero lot ling development. Jim Dower, Director of Public Service, addressed the commission and stated that the developer has stalled about 70 percent of the utilities, and would like to get final plat approval. He told the commission that they have presented him a letter of credit for the balance ref the improvements. Mr. T~awer also informed the commission that the drainage r_asement has beers changed to 15 feet, as it was not adequate as previousllt presented. He then told the commission that staff recommends approval of this final. plat. Cr. McKay moved, seconded by Cr. t`'orbes, to approve the final plat of Los Cedros Subdivision, subject to staff approval_ All voted in favor and the motion oarriACl- OTHER BUSINESS. Discussion and consideration of the final recommendaticana to the city council concerning the compre ens ve p an capital provement pro3ects. The planning director presented a draft statement of comprehensive plan capital improvements for the commission's review for the commission to formally adopt to present to the city council. He also presented a letter from Dennis Kneese concerning the parks and recreations recommended capital improvements. The commission d13euESed the document and parks departments recommendations, and recommended a some changes to the CzP. They then asked the planning director to give them a copy of the final document to review for recommendation to city council. The planning director stated that he Would provide each gn undated document prior to their next meeting 'Y'he commission then agreed to individually give their review and comment to the planning director prior to the presentation to city council- VISITOR'S COMMENTS. None. STAFF REPORTS: The planning director handed out a definition from the coning ordinance on home occupation. He Explained that the definition is a little vague and might need some clarification and may need to be tightened up some. The chairman stated that the commission will review this for changes to be made at a future meeting. The commission then discussed the meeting time for their January 5 meeting and stated that if there were no agenda itemE to discuss, tv have their meeting start at 5:00 for their final review of the resolution and CIP document for teeotnmendation to city council at the 6:30 city council meeting. ADJOURNMENT: Cr. McAshan moved, seconded by Cr. ForbeN, to adjourn the meeting at 6:30 p.m. All voted in favor and the motion carried.
