Lackey, Commissioner RE: Progress Report -Schematic Design Phase for Kerr County Animal Shelter -Architect's Project: KCAS. Our firms had hoped to be presenting final Schematic Documents to you for approval this date. However, several unforeseen events have caused us to postpone this schedule. By way of explanation: 1. On February 8, we received the survey, which is not as thorough as anticipated and some field and computer work was required to make it more usable. 2. We were asked to make a separate budget for grant applications, which is beyond the scope of our services, but we were pleased to assist. 3. It has become necessary to thoroughly research the kennel issue. While it was uncertain if kennels were in our responsibility, it has become apparent and very logical, that if these kennels are to be built in and plumbed, and their sizing is very critical to our space allocations, then we should be including them into the Construction Amount. 4. To a greater extent than anticipated, we had to devote time to advertising for contractors, which required a very special attention to detail and legality through the office of the County Attorney. This is not something we usually do at this phase of a project, but something that we all agreed would be beneficial to our Project's time line, if we are to meet our very tough schedule. There have been two very strong and encouraging general contractor responses, but no project manager candidates to date, except that the two contractor candidates each picked up project manager packages, also. 5. Additionally, we encountered 2 more diversions on City of Kerrville requirements: It was requested that we consider using (for wash-down) treated (but not potable) water from the Sewage Treatment Plant next door. This will result in reduced water rates for the facility, but slightly higher construction cost, for a dual system in the building. It would be more time effective if the Commissioners' Court could deal with the City on this issue. More importantly, we discovered that this site was zoned Agricultural; therefore, without adding the time burden of a zoning change or variance request, it was confirmed by City Planning Director Vetter that this would add 25 feet setbacks on the other 3 sides of the site, in addition to the 50 feet setback on Loop 534 frontage. i3o3 VESPER LANE KERRVILLE, TEXAS 78oz8 (zio) 895•ARCH This has been reflected in the Site Analysis which we include in this Report. Please review the Site Analysis and give us any feedback as soon as possible, so that we may include same in our continuing design refinements. We will probably request the Court's review next week for the hopefully finished Schematic Design. Meanwhile we will be reviewing the design with the other members of the County's designated architectural committee for additional input. Later this week, we have tentatively scheduled the geotechnical testing, pending Schematic Design concurrence.. The preliminary estimating on the kennels has been encouraging. Perhaps the most undecided unit is affordable small stacked kennels. There are very limited selections for those which would allow hose cleaning, thus insure more sanitary coriditions. But we still have inquiries out. There appears to be very little cost difference between manufactured and locally custom-made units. Timing on delivery may be a more critical factor. The 2 very Schematic Plans enclosed do represent some compromises, but we feel that all things considered these may be the most workable. The City may have some say about the off-street head-in parking on Landfill Road (our most economical scheme). It is unknown whether this street is dedicated or is considered a private street. Again, Commissioners' Court assistance would be appreciated in resolving this question with the City. Additionally, there are still a few other items left over from our earlier communications, for which we request the Court's attention: I . It appears that suitable imported backfill will probably be required. Therefore, we will see if Drash & Focht lab will test sample of imported soil for suitability or County may elect to use testing lab on Jail. 2. County will negotiate gate entrance modifications with City, based on Site Analysis; County will seek any variances from City on driveway and setback requirements, if needed. 3. It is assumed that animal waste from wash-down maybe mixed with normal sanitary sewer. Mr. George Ken at the City assured us that this would not be a problem with the grinder sewer pump which they intend to install. Large volumes of animal waste will possibly betaken to the landfill for the near future, but may be part of the incineration/cremation solution in the future. Perhaps more clarification on these issues would be in order to make sure nothing major gets overlooked. 4. County will pursue appliances, portable cages, and other special equipment, including the euthanasia chamber. Please forward special mechanical, electrical, and other requirements to us for inclusion in the project at the earliest possible date. Apparently the concept of a preselected general contractor or project manager has been embraced by all. Given that, we are recommending and working toward a Revised Time Schedule for Owner's consideration (set to coincide with regularly scheduled Commissioner's Court Meetings, KCAS -KERB COUNTY ANIMAL SHELTER -Page 2 but special meetings maybe called by Court). BOX 765 KERRVILLE, TEXAS 78029-0765 the Project: Kerr County Animal Shelter Location: State Highway Loop 534 at Landfill Road, Kerrville, Kerr County, Texas, according to a plat thereof of record in Plat Records of Ken County, Texas. with Preliminary Estimating Documents prepared by the Architect: Michael Neal Walker 1303 Vesper Lane Kemille, Texas 78028 The Owner and Contractor agree as set forth below: ARTICLE 1 THE WORK Contractor has submitted a Proposal and Qualifications to be the Contractor for the above mentioned Project, including a Maximum Preliminary Cost Estimate for the Project of one hundred seventy thousand three hundred dollars and no/ 100 ($170,300.00), which is attached hereto as Amendment A. This Estimate is within the Cost that the Owner has budgeted for the project. If the Cost for the Project can be held under the Maximum Budgeted Amount of One hundred seventy five thousand and no/100 ($175,000.00), as further provided herein, then the Owner shall subsequently enter into a Contract for Construction (on AIA form A101) with the Contractor to construct the Project. Therefore, the purpose of this Agreement is to have the Contractor perform such Preliminary Work in order to: assist in controlling the Cost of the Project, expedite the Contract Documents preparation and the Bidding process, and become the Contractor for Construction. Time is the essence of this Contract. The final construction work of the Project must be substantially complete and read}~ to occupy by June 25, 1995. Contractor shall consult with and make recommendations to Architect and Owner, in a timely manner. Contractor shall use his best efforts to perform the Preliminary Contracting Work required to provide expertise and labor necessary to accurately estimate the Cost for the above Project, including the taking of materials, installation KCAS - OWNER/CONTRACTOR AGREEMENT FOR PRELIMINARY CONTRACTOR SERVICES -PAGE 1 labor, and subcontracting bids. Such recommendations may result in the Architect modifying the proposed Contract Documents for Construction to incorporate same into the Project. Neither the Architect nor the Contractor shall have the final decision on any modifications or recommendations. The final decision shall remain the exclusive right of the Owner. It is the intention of the Owner and Contractor to enter into a subsequent Agreement for Construction for the Project. pending the Contractor's success in advising and assisting in controlling the cost for a Contract Amount acceptable to the Owner, but not to exceed the Maximum Budgeted Amount. The final Contract for Construction shall be for a Lump Sum Contract Amount which the Contractor shall Guarantee as a Maximum Cost to the Owner. ARTICLE 2 TIME OF COMMENCEMENT AND COMPLETION The Work to be performed under this Contract shall be commenced on the date of execution of this Agreement and, subject to authorized adjustments, Completion shall be achieved not later than April 1, 1995. ARTICLE 3 CONTRACT SUMS The Owner shall pay no funds to the Contractor for performance of the Work of this Agreement. ARTICLE 4 TERMINATION Agreement shall not be terminated by the Owner or Contractor, except for reasons of non-performance or incapacit}~ of either party, non-payment or abandonment of the Project by the Owner. This Agreement shall terminate upon execution of a subsequent Owner/Contractor Agreement for Construction, or on April 1, 1995, whichever occurs first. END OF OWNER/CONTRACTOR AGREEMENT file:kcascag.edl KCAS - OWNER/CONTRACTOR AGREEMENT FOR PRELIMINARY CONTRACTOR SERVICES -PAGE 2 This Agreement entered into as of the date first written above. We propose to perform the work on a cost plus a fee basis. Costs would be defined by the American Institute of Architects (AIA) standard contract definition of costs. These are outlined as follows: 1. Labor costs includmg all taxes, benefits and insurance. 2. Material costs including freight and applicable taxes if any. 3. Subcontract costs. 4. Equipment rental costs. 5. General liability insurance costs. 6. Builder's risk insurance costs. 7. Payment and performance bond costs. 8. Supervision and Project Management. The following items would not be considered cost of the work and would be included in the fee: 1. Office overhead. 2. Accounting operations. We propose to perform the work at a 15% fee or a maximum of $22,000.00. We would propose to approach the project as a joint venture between Huser Construction and Danco Construction. Huser Construction would be the contractor of record and would provide the payment and performance bonding and insurance. Danco Construction would provide additional experience and local expertise. Supervision for the project would be by Steve Huser and Danny Wheat or a qualified superintendent. In addition we would appoint an on-site working foreman who could accept deliveries and direct subcontractors in our absence. A list of clients and architects are contained in the Contractor's Qualification Statement herewith. This list pertains primarily to projects completed locally by Danco Construction. References for Steve Huser are also contained in the Contractor's Qualification Statement. Our bonding company is FBr,D (Fidelity and Deposit Company of Maryland}. Our agent is John L. Wortham and Son L.L.P. in Houston. During the time I worked for a mechanical contractor, I completed two similar projects. One was a 150,000 SF animal research facility in Rockville Maryland for the American Red Cross. This facility had many animal cages as well as special HVAC applications for the labs and surgery. I also worked on a animal research project for the Texas Heart Institute at St. Luke's Episcopal Hospital in Houston, Texas. This project also had special cages, watering and HVAC systems because the research animals were kept in a sterile environment. This project was approximately 40,000 SF in an existing hospital - H USES CONSTRUCTION COMPANY, INC. PROPOSAL We propose to provide preconstrucrion and general construction services on the Kerr County Animal Shelter project m Kerrville, Texas. We propose to work with the Architect during the design and construction stages of the project to insure that the County receives the maximum benefit in value, cost and time for the resources committed. We have reviewed the preliminary budget as contained in the bid package and judge it to be reasonable for the scope outlined and therefore propose that the Architect's estimate be our preliminary Guaranteed Maximum Cost (GMC) subject to revisions as outlined below. We further believe that potential savings exist in some areas of the budget. We propose to perform the work on a cost plus a fee basis. We would work with the Architect during the design phases of the project to establish and refine the Guaranteed Maximum Cost (GMC) of the project. We will expose all pricing during the design phases of the project to the Architect. We will establish a Final Guaranteed Maximum Cost (FGMC) amount at the completion of the construction documents. By working with the Architect during the design phase of the project, we anticipate that we will have a good idea of the (FGMC) amount prior to the issuance of the final drawings. Therefore, we will confirm and commit to a (FGMC) price within three working days of the issuance of the final construction plans by the Architect. In the event that the (FGMC) pricing is not within the County's budget, ($170,300.00 including $20,000.00 for cages) the work may proceed with County's approval or we will donate our preconstruction services and the County may select another contractor. At that time our agreement with the County would become null and void. We have reviewed the preliminary schedule for the project. Since it is most aggressive we have added our CPM (Critical Path Method) schedule to show in more detail how the project might be constructed. We think that the completion date is achievable providing that the design and information milestones are met. In order to meet the schedule for both pricing and construction we propose to preselect and prequalify the subcontractors. During the seven years I worked at St. Luke's Episcopal Hospital and Texas Children's Hospital in Houston, 99% of their work was built as described above. Also, Danny and I are working together on the addition to the First Presbyterian Church in Kerrville. It too is a negoiated project where we are assisting the Architect in preparing a design within budget and construction time constraints. This Estimate is within the Cost that the Owner has budgeted for the project. If the Cost for the Project can be held under the Maximum Budgeted Amount of One hundred seventy five thousand and no/100 ($175,000.00), as further provided herein, then the Owner shall subsequently enter into a Contract for Construction (on AIA form A101) with the Contractor to construct the Project. Therefore, the purpose of this Agreement is to have the Contractor perform such Preliminary Work in order to: assist in controlling the Cost of the Project, expedite the Contract Documents preparation and the Bidding process, and become the Contractor for Construction. Time is the essence of this Contract. The final construction work of the Project must be substantially complete and ready to occupy by June 25, 1995. Contractor shall consult with and make recommendations to Architect and Owner, in a timely manner. Such recommendations may result in the Architect modifying the proposed Contract Documents for Construction to incorporate same into the Project. Neither the Architect nor the Contractor shall have the final decision on any modifications or recommendations. The final decision shall remain the exclusive right of the Owner. It is the intention of the Owner and Contractor to enter into a subsequent Agreement for Construction for the Project, pending the Contractor's success in advising and assisting in controlling the cost for a Contract Amount acceptable to the Owner, but not to exceed the Maximum Budgeted Amount. The final Contract for Construction shall be for a Lump Sum Contract Amount which the Contractor shall Guarantee as a Maximum Cost to the Owner. ARTICLE 2 TIME OF COMMENCEMENT AND COMPLETION The Work to be performed under this Contract shall be commenced on the date of execution of this Agreement and, subject to authorized adjustments, Completion shall be achieved not later than April 1, 1995. ARTICLE 3 CONTRACT SUMS The Owner shall pay no funds to the Contractor for performance of the Work of this Agreement. ARTICLE 4 TERMINATION Agreement shall not be terminated by the Owner or Contractor, except for reasons of non-performance or incapacity of either party, non-payment or abandonment of the Project by the Owner. This Agreement shall terminate upon execution of a subsequent Owner/Contractor Agreement for Construction, or on April 1, 1995, whichever occurs first. Costs would be defined by the American Institute of Architects (AIA) standard contract definition of costs. These are outlined as follows: 1. Labor costs includmg all taxes, benefits and insurance. 2. Material costs including freight and applicable taxes if any. 3. Subcontract costs. 4. Equipment rental costs. 5. General liability insurance costs. 6. Builder's risk insurance costs. ?. Payment and performance bond costs. 8. Supervision and Project Management. The following items would not be considered cost ofthe work and would be included in the fee: 1. Office overhead. 2. Accounting operations. We propose to perform the work at a 15% fee or a maximum of $22,000.00. We would propose to approach the project as a joint venture between Huser Construction and Danco Construction. Huser Construction would be the contractor of record and would provide the payment and performance bonding and insurance. Danco Construction would provide additional experience and local expertise. Supervision for the project would be by Steve Huser and Danny Wheat or a qualified superintendent. In addition we would appoint an on-site working foreman who could accept deliveries and direct subcontractors in our absence. A list of clients and architects aze contained in the Contractor's Qualification Statement herewith. This list pertains primarily to projects completed locally by Danco Construction. References for Steve Huser are also contained in the Contractor's Qualification Statement. Our bonding company is F&D (Fidelity and Deposit Company of Maryland). Our agent is John L. Wortham and Son L.L.P. in Houston. During the time I worked for a mechanical contractor, I completed two similar projects. One was a 150,000 SF animal research facility in Rockville Maryland for the American Red Cross. This facility had many animal cages as well as special HVAC applications for the labs and surgery. I also worked on a animal research project for the Texas Heart Institute at St. Luke's Episcopal Hospital in Houston, Texas. This project also had special cages, watering and HVAC systems because the research animals were kept in a sterile environment. This project was approximately 40,000 SF in an existing hospital - H USED CONSTRUCTION COMPANY, INC. PROPOSAL We propose to provide greconstruction and general construction services on the Ken County Animal Shelter project in Kerrville, Texas. We propose to work with the Architect during the design and construction stages of the project to insure that the County receives the maximum benefit in value, cost and time for the resources committed. We have reviewed the preliminary budget as contained in the bid package and judge it to be reasonable for the scope outlined and therefore propose that the Architect's estimate be our preliminary Guaranteed Maximum Cost (GMC) subject to revisions as outlined below. We further believe that potential savings exist in some areas of the budget. We propose to perform the work on a cost plus a fee basis. We would work with the Architect during the design phases of the project to establish and refine the Guaranteed Maximum Cost (GMC) ofthe project. We will expose all pricing during the design phases of the project to the Architect. We will establish a Final Guaranteed Maximum Cost (FGMC) amount at the completion of the construction documents. By working with the Architect during the design phase of the project, we anticipate that we will have a good idea of the (FGMC) amount prior to the issuance of the final drawings. Therefore, we will confirm and commit to a (FGMC) price within three working days of the issuance of the final construction plans by the Architect. In the event that the (FGMC) pricing is not within the County's budget, ($170,300.00 including $20,000.00 for cages) the work may proceed with County's approval or we will donate our preconstruction services and the County may select another contractor. At that time our agreement with the County would become null and void. We have reviewed the preliminary schedule for the project. Since it is most aggressive we have added our CPM (Critical Path Method) schedule to show in more detail how the project might be constructed. We think that the completion date is achievable providing that the design and information milestones are met. In order to meet the schedule for both pricing and construction we propose to preselect and prequalify the subcontractors.
