Bailey, Assistant County Attorney Date: August 29, 1995 Re: Two Real Estate Lien Notes For Purchase of Real Property By County As we discussed today, attached are copies of the two real estate lien notes that the county is obligated on for a period in excess of our current fiscal year. Tommy Tomlinson, the Kerr County Auditor, recommends that we pay off the notes within this fiscal year to avoid any questions regarding the constitutionality of this debt, and I concur with this recommendation. The other alternative would be to amend the notes to reflect that the county is obligated under the notes only to the extent that we appropriate money during any fiscal year to pay for the debt, but I suspect that the Payees would not want to agree with such modification.
