In the Interagency Agreement Review and Approval you will find in Article III (matching funds) Kerr County listed as contributing a total of $55,291. The breakdown is fringe benefits paid for two persons from your entity serving with the Task Force along with salary and fringe benefits for an assistant district attorney as currently budgeted. At the beginning of each month the gross salary for these two persons serving on the Task Force would be forwarded to you to distribute through your payroll. (.10.T Issued 10/94 KERR COUNTY COURT ORDER NO. ,507 A RESOLUTION OF THE KERR COUNTY COMMISSIONERS' COURT TO APPLY FOR FINANCIAL ASSISTANCE FROM THE CRIMINAL JUSTICE DIVISION OF THE STATE OF TEXAS TO CONTINUE THE LARGE SCALE ASSAULT ON DRUG ABUSE IN OUR COMMUNITIES WI-IEREAS, in 1987, the 216th Judicial District Narcotics Task Force was established for a five county Narcotics Enforcement Team comprised of Kerr, Bandera, Kendall, Kimble and Gillespie counties; City of Kerrville, City of Ingram, City of Bandera, City of Boerne, City of Fair Oaks Ranch and City of Fredericksburg, all of which are members of the Alamo Area Council of Governments and comprise the 216th District Court under the Direction of District Attorney E. Bruce Cuny; and WHEREAS, since December 1987, the 216th Judicial District Narcotics Task Force has averaged 18 narcotic arrests per month and seized narcotics valued at over $2,742,125.00; and seized assets valued over $616,657.00. WHEREAS, the 216th Judicial District Narcotics Task Force has shown it can produce results that are tangible; and WHEREAS, the 216th Judicial District and its law enforcement agencies desperately need financial assistance from the Criminal Justice Division of the State of Texas to continue the large scale assault on the drug problems; and WHEREAS, continued funding is also needed to educate our public in the dangers of drugs, and to attack the drug problem as its exists in our community as the 216th Judicial District Narcotics Task Force has presented their drug program to organizations/schools involving over 2,352 persons. NOW THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS' COURT OF KERR COUNTY, TEXAS; That Kerr County hereby joins in the grant application with the Criminal Justice Division of the State of Texas in the amount of $667,840.00 in order to maintain the 216th Judicial District Narcotics Task Force; and That the cash match (being 25% of total grant) is the amount of $166,960.00 will be participated in by Kerr County using program income accumulated to date by the 216th Judicial District Narcotics Task Force, Tinge benefits for Kerr County Employees serving on the Task Force and salary and fringe benefits for an Assistant District Attorney based on final awarding of grant application. NOW THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: ARTICLE PURPOSE 1.01 The purpose of this Agreement is to allow "Counties" and "Cities" to file joint applications for a Narcotics Task Force Grant, with the Criminal Justice Division, which creates the 216th JUDICIAL DISTRICT NARCOTICS TASK FORCE which application is attached hereto as exhibit "A" and made a part hereof for all purposes. ARTICLE V OWNERSHIP OF EQUIPMENT 5.01 upon termination of this Agreement, ownership of equipment hardware, and other non-expendable items will revert to the applicant for which it was acquired, subject to the approval of the Criminal Justice Division of the Governor's Office. ARTICLE VI AMENDMENTS 6.01 This Agreement may be amended by the mutual agreement of the parties hereto in writing to be attached to and incorporated into this agreement. ARTICLE VII LEGAL CONSTRZCTZONS 7.01 In case any one or more the provisions contained in this Agreement shall be held to be invalid, illegal, or unenforceable in any respect such invalidity, illegality or unenforceable shall not affect by any other provision thereof and this agreement shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein. ARTICLE VIII ENTIRE AGREEMENT 8.01 This Agreement supersedes any and all other agreements, either oral or in writing, between the parties hereto with respect to the subject matter hereof, and no other agreement, statement, or promise relating to the subject matter of this Agreement which is not contained herein shall be valid or binding. (2) The applicant assures that matching funds required to pay the non-federal portion of the cost of each program and project, for which grant funds are made available, shall be in addition to funds that would otherwise be made available for law enforcement by the recipients of grant funds. (3) The applicant assures that fund accounting, auditing, monitoring, and such evaluation procedures as may be necessary, to keep such records as CJD shall prescribe, shall be provided to assure fiscal control, proper management, and efficient disbursement of funds received under the grant. (4) The applicant assures that it shall maintain such data and information and submit such reports, in such form, as such times, and containing such information as CJD may require. (5) The applicant certifies that the programs contained in its application meet all requirements,. that all the information is correct, that there has been appropriate coordination with affected agencies, and that the applicant will cofmply with all provisions of the grant and•all other applicable federal and state laws, regulations, and guidelines. (6) The applicant assures that it will comply, and all its contractors will comply, with the nondiscrimination requirements of the Justice Assistance Act; Title VI of the Civil Rights Act of 1964; Section 50¢ of the Rehabilitation Act of 1973, as amended; Title IX of the Education Amendments of 1972; the Age Discrimination Act of 1975; the Department of Justice Nondiscrimination Regulations 28 CFR Part 42, Subparts C,D,B, and G; and Executive Order 11246, as amended by Executive order 11375, and their implementing regulations, 41 CFR Part 60.1 et seq., as applicable to construction contracts. (7) The applicant assures that in the event a federal or state court or federal or state administrative agency makes a finding of discrimination after a due process hearing on the grounds of race, color, religion, national-origin, or sex against a recipient of funds, the recipient will forward a copy of the finding to the Office of Civil Rights Compliance (OCRC), Office of Justice Program, and the Criminal Justice Division. (8) The applicant assures that it will require that every recipient required to formulate an Equal Employment Opportunity Program (EEOP), in accordance with 28 CFE 42.301 etseq., submit a certification to the state that it has a current EEOP on file which meets the requirements therein. (9) The applicant assures that it will prove an EEOP, if required to maintain one, where the application is for ;500,000 or more. (10) The applicant assures that it will comply with the provisions of the office of the Justice Programs' "Financial and Administrative Guide for Grants", M7100.1D.
