Your Honor:
This requested hearing concerns the manner in which The Woods Subdivision was included in the
formation of the proposed Kerrville South Rural Fire Protection District.
The people in The Woods were not aware of this action until after the Community Action Group
(C.A.G.) Meeting. Our committee met with Mr. William D. Pearson, Chairman of the C.A.G., to
request that he call another meeting to give the people of The Woods a chance to vote on our
being included in this proposed fire district. He refused.
We ask Mr. Pearson for the minutes of both meetings and he said that there are no minutes. We
then ask for a list of the people who attended these meetings. He could not produce such list.
Under the Open Meetings Act, I believe that the above records are mandatory.
We understand that under State Statue 794, Health and Safety Code, Section 794-016, the
Commissioner's Court has the exclusive jurisdiction to determine this issue relative to the creation
of a fire district. Also, under Section 794-017, the Commissioner's Court shall set the district
boundaries.
Therefore, we the people of The Woods Subdivision, request that we not be included in this
proposed Kerrville South Rural Fire Protection District.
