The City Council approved this contract during the October 10, 1995 meeting. State law requires a quarterly report to be made to the city of how all hotel/motel funds are spent. It will be necessary for the city to receive this report before any new quarterly allocation is made. If you received monies in fiscal year 94-95, the city will need a September 30, 1995 quarterly report before the first payment can be made to you on November 10, 1995. Tune Assistant City Manger ms Enclosure h C,r• 800JUNCTIONHIGMNAY • KERRVILLE,TEXAS780285069.210/257-8000 STATE OF TEXAS COUNTY OF KERB This agreement made and entered into by the City of Kerrville, a municipal corporation, hereinafter referred to as "City", and Kerr County, each acting by and through its authorized officials, pursuant to the following terms and conditions: City agrees to pay $17,874.80 to Kerr County for the fiscal year 1995-96, with payment to be made in four equal installments. The first payment of $4,468.70 will be made on November, 10, 1995. The second payment of $4,468.70 to be made on February 10, 1996, the third payment of $4,468.70 to be made on May 10, 1996, and the final payment of $4,468.70 to be made on August 10, 1996. City shall make such payments solely from the current or accumulated revenues from the hotel/motel occupancy tax. This contract assumes total hotel/motel occupancy tax collections of $504,017.00 in fiscal 95-96. In the event collections are less, payments hereunder shall be reduced proportionately. Kerr County agrees to utilize the funds to lower the ceiling and install new lighting at the ag barn as requested. Failure to do so would cause the funds to be forfeited. Kerr County shall keep records and accounts of all income and expenditures. Kerr County shall furnish copies to City on a quarterly basis, including a listing of expenditures made from the tax revenues provided by City hereunder. Kerr County will establish a separate bank account for deposit and expenditure of these funds so as to avoid any commingling of funds. Kerr County will permit authorized officials of the City of Kerrville to review its books at any time. Iv. Any default hereunder, at the option of the City Council, may result in loss of future funds, and the requirement that Kerr County reimburse past funds paid by the City for the current year. V. The term of this agreement shall be for a period of one (1) year, beginning on October 1, 1995, and ending on September 30, 1996.
